An Act to Amend the Energy and Utilities Board Act Loi modifiant la

Section 1 of the Energy and Utilities Board Act,

chapter E-9.18 of the Acts of New Brunswick, 2006, is amended in the French version of the definition « Com- mission » by adding “du Nouveau-Brunswick” after “des services publics”. 1 L’article 1 de la

Loi sur la Commission de l’énergie et des services publics,

chapitre E- 9.18 des Lois du Nouveau-Brunswick de 2006, est modifié à la version française de la définition « Commission » par l’adjonc- tion de « du Nouveau-Brunswick » après « des services publics ». 2

Section 2 of the Act is amended by striking out “Where any provision of this Act” and substituting “Ex- cept as provided in

section 72, where any provision of this Act”. 2 L’article 2 de la Loi est modifié par la suppression de « En cas d’incompatibilité » et son remplacement par « Sauf disposition contraire de l’article 72, en cas d’in- compatibilité ». 3

Section 14 of the Act is amended 5 L’article 14 de la Loi est modifié (

a) by renumbering the

section as subsec- tion 14(1);

Article 11 Texte de la disposition actuelle : 48(1) Where the Board is required to hold a hearing under any Act, it shall notify the Minister of Justice and Consumer Affairs of the hear- ing and shall provide the Minister with copies of relevant material upon the request of the Minister. 48(1) Lorsque la Commission est tenue par une loi quelconque de tenir une audience, elle doit en aviser le ministre de la Justice et de la Consommation et lui fournir des copies des documents pertinents à la demande de ce dernier. 48(2) The Minister of Justice and Consumer Affairs may appoint a public intervener to participate for the purposes of any hearing before the Board, and shall determine the mandate of the public intervener when participating in such hearing. 48(2) Le ministre de la Justice et de la Consommation peut mandater une personne pour agir comme intervenant public pour toute audience de la Commission.

a) a person that owns, operates, manages or controls any plant or equipment for the production, transmission, delivery or furnish- ing of water or natural gas, or that provides such other service as may be prescribed by regulation, either directly or indirectly, to or for the public,

b) when specified by regulation, any municipality or rural com- munity that owns, operates, manages or controls any plant or equip- ment for the production, transmission delivery or furnishing of water or natural gas, either directly or indirectly, to any person outside its own limits, and

Section 16 The existing provision is as follows:

Article 16 Texte de la disposition actuelle : 85(1) The appointments of all persons who hold office as a member of the Board of Commissioners of Public Utilities, including the Chair- man, immediately before the commencement of this

section are re- voked. 85(1) Immédiatement avant l’entrée en vigueur du présent
