B.C. Reg. 94/2010 , deposited April 1, 2010, pursuant to the HEALTH PROFESSIONS ACT [Section 12]. Ministerial Order M103/2010, dated March 31, 2010.

I, Kevin Falcon, Minister of Health Services, order as follows:

1 Effective April 1, 2010, the Speech and Hearing Health Professionals Regulation, B.C. Reg. 413/2008, is amended as set out in the attached schedule.

2 Effective April 1, 2011, the Speech and Hearing Health Professionals Regulation, B.C. Reg. 413/2008, is amended by repealing

section 6 (3) and substituting the following:

(3) A hearing instrument practitioner who is not also an audiologist may, in respect of an individual who has not attained the age of 16 years, provide a service that includes the performance of a restricted activity set out in

section 5 (2) (b), (c), (

e) or (

f) only if the hearing instrument practitioner has successfully completed a certification program established, required or approved under the bylaws to ensure hearing instrument practitioners are qualified and competent to provide the service and perform the restricted activity.

Schedule

Section 5 (3) of the Speech and Hearing Health Professionals Regulation, B.C. Reg. 413/2008, is amended by adding the following paragraph:

(

g) administer topically a drug that

(

i) is specified in

Schedule I or

Schedule II of the Drug Schedules Regulation, B.C. Reg. 9/98, and

(ii) is an anaesthetic,

for the purposes of performing a restricted activity set out in paragraphs (

c) to (e).

Section 6 is amended

(

a) in subsection (1) by striking out " (5) (1) (

c) or (

d) or (2) (

b) or (c) " and substituting " (5) (1) (

b) to (

d) or (2) (

a) to (c) ",

(

b) by repealing subsection (3) and substituting the following:

(3) A hearing instrument practitioner who is not also an audiologist may, in respect of an individual who has not attained the age of 16 years, provide a service of hearing instrument dispensing only if

(

a) the individual has been examined, within the 6 months immediately preceding the date the service is provided, by an otolaryngologist and an audiologist, and

(

b) the hearing instrument practitioner has a copy of each diagnosis which recommends that the individual use a hearing instrument. , and

(

d) in subsection (4) by striking out " 5 (3) (c), (

d) or (e) " and substituting " 5 (3) (

c) to (

e) or (g) ".
