Citation

1 These regulations may be cited as the Importing Alcoholic Beverages for Personal Use

Regulations .

Definitions

2 In these regulations,

“alcoholic beverage” means a beverage containing spirits, wine, beer or any other

liquor in a form appropriate for personal consumption as a beverage, alone or in

combination with any other ingredients, with more than 0.5% alcohol by volume at

15.5°C of absolute alcohol;

“direct to consumer agreement” means an agreement between the Province and

1 or more Canadian jurisdictions that allows for importing alcoholic beverages into

(

i) the Province by individuals for their personal consumption, when

purchased from a manufacturer in the other Canadian jurisdiction or

jurisdictions, and

(ii) the other Canadian jurisdiction or jurisdictions by individuals in that

jurisdiction for their personal consumption, when purchased from a

manufacturer in the Province;

“manufacturer” means a manufacturer of alcoholic beverages;

“reciprocating jurisdiction” means a province or territory that has entered into a

direct to consumer agreement with the Province.

3 An individual may import alcoholic beverages into the Province from a reciprocating

jurisdiction for their personal consumption and not for resale or other commercial use

only if all of the following conditions are met:

(

a) the alcoholic beverage was produced by a manufacturer in a manufacturing

facility that is located in a reciprocating jurisdiction;

(

b) the manufacturer that produced the alcoholic beverage is duly licensed or

otherwise legally permitted under the laws of the reciprocating jurisdiction

to manufacture and sell the alcoholic beverage;

(

c) the individual buys the alcoholic beverage from the manufacturer that

produced it.

4 The Minister must ensure that a list of all reciprocating jurisdictions is made accessible

to the public by posting the list on the Department of Finance and Treasury Board’s

website or by any other means that the Minister considers appropriate.
