OIC Text: The Governor in Council on the report and recommendation of the Minister of Natural Resources dated May 12, 2011, and pursuant to Sections 7 and 16 of

Chapter 114 of the Revised Statutes of Nova Scotia, 1989, the Crown Lands Act, and

Section 19 of

Chapter 235 of the Revised Statues of Nova Scotia, 1989, the

Interpretation Act, is pleased to: (

a) rescind Order in Council 2008-635 dated December 9, 2008; (

b) authorize the Minister of Natural Resources on behalf of Her Majesty the Queen in right of the Province of Nova Scotia to convey by deed or grant a lot of Crown land, shown in dark grey on

Schedule "B" attached to and forming part of the Report and Recommendation, containing approximately 283 hectares (700 acres) together with a right of way or easement 20.12 metres (66 feet) in width at Black Point, Fox Island Main in the County of Guysborough to the Municipality of the District of Guysborough, its successors or assigns subject to the terms and conditions outlined in paragraph (c); (

c) authorize the Minister of Natural Resources on behalf of Her Majesty the Queen in right of the Province of Nova Scotia to acquire from the Municipality of the District of Guysborough, its successors or assigns, the lands shown in dark grey on

Schedule "C" attached to and forming part of the Report and Recommendation, containing approximately 442 hectares (1092 acres) at Fox Island Main and Mattie Settlement, in the County of Guysborough, in exchange for the Crown land noted in paragraph (

b) subject to the condition that the Municipality of the District of Guysborough, its successors or assigns, be able to certify title to the land in a manner deemed sufficient by the Department of Justice; and (

d) authorize the Minister to execute such documents as may be required to achieve the purpose of this Order.
