Interpretation Act Police Act

OIC Text: The Governor in Council on the report and recommendation of the Minister responsible for the Nova Scotia Police Review Board dated October 29, 2012, and pursuant to Section18A of

Chapter 235 of the Revised Statutes of Nova Scotia, 1989, the

Interpretation Act, and

Section 15 of

Chapter 31 of the Acts of 2004, the Police Act , is pleased to, effective November 27, 2012: (

a) order that Linda Garber shall have and exercise the jurisdiction of a member of the Police Review Board in respect of any application, appeal, proceeding, matter or thing heard before the member or commenced by the member as a member of that body, including the power to complete any unfinished matter and give a decision in that matter as if her term of office had not expired, for further period of three months from November 7, 2012, to February 7, 2013; (

b) fix the remuneration of Linda Garber as a member of the Nova Scotia Police Review Board at $150 per meeting; and (

c) order that the Province shall defend, negotiate or settle claims or charges made against Linda Garber and indemnify her from personal liability in connection with any such claim, provided, however, that the Province is satisfied that the claim arises out of her activities in relation to her appointment, and is not based on fraud or criminal activity, and where the Province so defends her, the Province will be in control of the case.
