Section 28 of the Employment Standards Act, chap- ter E-7.2 of the Acts of New Brunswick, 1982, is amended 1 L’article 28 de la

a) by repealing the portion preceding paragraph (

a) and substituting the following:

2 The Act is amended by adding after

section 44.027 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 44.027 : EMERGENCY LEAVE CONGÉ EN CAS D’URGENCE Emergency leave Congé en cas d’urgence 44.028(1) If it is necessary in the opinion of the Lieutenant-Governor in Council, an employer shall grant an employee a leave of absence in any of the following circumstances: 44.028(1) Lorsque le lieutenant-gouverneur en conseil détermine que cela s’avère nécessaire, l’employeur est tenu d’accorder au salarié un congé dans les cas sui- vants : (

a) when the Minister of Public Safety declares a state of emergency under the Emergency Measures Act in respect to all or any area of the Province;

a) le ministre de la Sécurité publique proclame l’état d’urgence dans tout ou

partie de la province en vertu de la

Loi sur les mesures d’urgence; (

b) when the Governor in Council declares a public welfare emergency, a public order emergency, an in- ternational emergency or a war emergency under the Emergencies Act (Canada);

Section 44.04 of the Act is amended 3 L’article 44.04 de la Loi est modifié (

a) in subsection (1) by repealing the portion pre- ceding paragraph (

b) par l’abrogation du paragraphe (3) et son rem- placement par ce qui suit : 44.04(3) Despite subsection (2), if an employee would have been suspended, laid off, dismissed or otherwise had his or her employment terminated had the employee not been granted a leave of absence under this Act, the seniority of the employee 44.04(3) Par dérogation au paragraphe (2), si un sala- rié aurait été suspendu ou mis à pied ou son emploi ces- sé, notamment par licenciement, si le congé ne lui avait pas été accordé en vertu de la présente loi, son ancienne- té : (

a) ceases to accrue as of the date the dismissal, in- cluding termination of employment, would have oc- curred had the employee not been granted the leave of absence, and

b) does not accrue during the period of the suspen- sion or layoff that would have occurred had the em- ployee not been granted the leave of absence.

i) the eligibility requirements for the leave of ab- sence; (

i) les critères d’admissibilité au congé, (ii) the purposes for which the leave of absence may be taken; (ii) les motifs pour lesquels le congé peut être pris, (iii) whether the leave of absence or any part of the leave of absence may be taken as paid or un- paid leave, or any combination thereof, and, if the leave of absence or any part of the leave of absence is paid leave, the rate of pay the employee is to be paid by the employer during the leave; (iii) la rémunération ou la non-rémunération de tout ou

partie du congé ou une combinaison des deux, et s’agissant d’un congé rémunéré, le taux de rémunération que doit payer l’employeur au salarié durant ce congé ou cette

partie de congé, (iv) the determination of different categories of leaves of absences and remuneration for any cate- gory of employee in any industry, business, trade or occupation; (iv) l’établissement de différentes catégories de congés ou de rémunérations pour différentes caté- gories de salariés selon l’industrie, l’activité com- merciale, le métier ou la profession, (

v) the deeming of a suspension, layoff, dismissal or termination of employment as a leave of absence under paragraph 44.028(1)(a), (b), (

c) or (d); (

(vii) the duration of the leave of absence, whether for a fixed or indeterminate period of time; (vii) la durée du congé, celle-ci pouvant être pour une période fixe ou indéterminée, (viii) the extension of a leave of absence; (viii) toute prolongation du congé, (ix) the right of the employee to interrupt or defer a leave of absence granted under this Act in order to take a leave of absence under paragraph 44.028(1)(a), (b), (

c) or (d); (ix) le droit du salarié d’interrompre ou de repor- ter un autre congé accordé en vertu de la présente loi afin de prendre celui prévu à l’ali- néa 44.028(1)a),

x) the verification that an employee is required to provide to an employer, if any, including the types of documentation that are acceptable, what information the documentation must contain and when the documentation must be provided; (
