Order in Council 471/2020, approved and ordered August 10, 2020.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that, effective September 1, 2020,

the following regulations are amended as set out in the attached Schedule:

(

a) Assisted Living Regulation, B.C. Reg. 189/2019;

(

b) Designation Regulation No. 2, B.C. Reg. 125/99;

(

c) Employment and Assistance Regulation, B.C. Reg. 263/2002;

(

d) Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002;

(

e) Employment Standards Regulation, B.C. Reg. 396/95;

(

f) Health Care Consent Regulation, B.C. Reg. 20/2000;

(

g) Hospital Act Regulation, B.C. Reg. 121/97;

(

h) Information Regulation, B.C. Reg. 208/2010;

(

i) Laboratory Services Regulation, B.C. Reg. 52/2015;

(

j) Residential Tenancy Regulation, B.C. Reg. 477/2003;

(

k) Statutory Property Guardianship Regulation, B.C. Reg. 115/2014.

Schedule

Assisted Living Regulation

Section 44 (3) (

b) of the Assisted Living Regulation, B.C. Reg. 189/2019, is

amended by striking out " British Columbia College of Nursing Professionals " and substituting " British Columbia College of Nurses and Midwives ".

Designation Regulation No. 2

Section 1 (

d) and (

j) of the Designation Regulation No. 2, B.C. Reg. 125/99,

is repealed and the following substituted:

(

d) the British Columbia College of Nurses and Midwives; .

Employment and Assistance Regulation

Section 1 (1) of the Employment and Assistance Regulation, B.C. Reg. 263/2002,

is amended by adding the following definition:

"midwife" means a registrant of the British Columbia College of Nurses and Midwives established

under the Health Professions Act who is authorized to use the title "midwife"; .

4 Sections 56.2 (2) and 75 (2) (

a) and

section 9 (b) (

i) of

Schedule C are amended

by striking out " registrant of the College of Midwives of British Columbia " and substituting " midwife ".

Employment and Assistance for Persons with Disabilities Regulation

Section 1 (1) of the Employment and Assistance for Persons with Disabilities

Regulation, B.C. Reg. 265/2002, is amended by adding the following definition:

"midwife" means a registrant of the British Columbia College of Nurses and Midwives established

under the Health Professions Act who is authorized to use the title "midwife"; .

6 Sections 54.3 (2) and 68 (2) (

a) and

section 8 (b) (

i) of

Schedule C are amended

by striking out " registrant of the College of Midwives of British Columbia " and substituting " midwife ".

Employment Standards Regulation

Section 33 (

a) of the Employment Standards Regulation, B.C. Reg. 396/95, is repealed

and the following substituted:

(

a) subject to paragraph (b), a student in an academic or technical program recognized

under the bylaws of the British Columbia College of Nurses and Midwives as meeting

a standard of academic or technical achievement required

(

i) for registration as a member of that college, and

(ii) to practise the designated health profession of nursing, practical nursing

or psychiatric nursing; .

Health Care Consent Regulation

Section 16 (

a) of the Health Care Consent Regulation, B.C. Reg. 20/2000, is amended

by striking out " British Columbia College of Nursing Professionals " and substituting " British Columbia College of Nurses and Midwives ".

Hospital Act Regulation

Section 7 of the Hospital Act Regulation, B.C. Reg. 121/97, is amended

(

a) in subsection (1) (a) (i.1) by striking out " or the College of Midwives of British Columbia ",

(

b) by repealing subsection (1) (a) (ii) and substituting the following:

(ii) practise a profession regulated by the British Columbia College of Nurses

and Midwives and to use the title "midwife", "nurse practitioner" or "registered nurse",

and ,

(

c) in subsection (4) (a.1) by striking out " or the College of Midwives of British Columbia ",

(

d) by repealing subsection (4) (

b) and substituting the following:

(

a) the College of Physicians and Surgeons of British Columbia or the College

of Dental Surgeons of British Columbia, or ,

(

e) by adding " and " at the end of subsection (6) (b),

(

f) by repealing subsection (6) (c), and

(

g) in subsection (6) (

d) by striking out " British Columbia College of Nursing Professionals " in both places and substituting " British Columbia College of Nurses and Midwives ".

Section 15 (3) and (4) is repealed and the following substituted:

(3) When the conduct or fitness to practise or the competence of a midwife or

nurse practitioner is under investigation or is the subject of an inquiry under the

Health Professions Act , the Board of the British Columbia College of Nurses and Midwives or its nominee

is authorized to examine the records of a hospital concerning any health care services

rendered to a patient by, as applicable, that midwife or nurse practitioner or under

the direction of that midwife or nurse practitioner.

Information Regulation

Section 3 (2) (h) (ii) and (iii) of the Information Regulation, B.C. Reg. 208/2010,

is repealed and the following substituted:

(ii) the British Columbia College of Nurses and Midwives, if the registrant is,

or the former registrant was, authorized to use the title "midwife", "nurse practitioner"

or "registered psychiatric nurse", .

Laboratory Services Regulation

Section 3 of the Laboratory Services Regulation, B.C. Reg. 52/2015, is amended

(

a) by repealing subsection (1) (b),

(

b) in subsection (1) (

d) by striking out " British Columbia College of Nursing Professionals who is authorized to use the

title " and substituting " British Columbia College of Nurses and Midwives who is authorized to use the title

"midwife", ", and

(

c) in subsection (2) (

a) by striking out " British Columbia College of Nursing Professionals " and substituting " British Columbia College of Nurses and Midwives ".

Residential Tenancy Regulation

Section 39 (

h) and (

i) of the Residential Tenancy Regulation, B.C. Reg. 477/2003,

is amended by striking out " British Columbia College of Nursing Professionals " and substituting " British Columbia College of Nurses and Midwives ".

Statutory Property Guardianship Regulation

Section 3 (2) (

b) of the Statutory Property Guardianship Regulation, B.C. Reg. 115/2014,

is amended by striking out " British Columbia College of Nursing Professionals " and substituting " British Columbia College of Nurses and Midwives ".
