An Act to Amend the New Brunswick Income Tax Act Loi modifiant la Loi de l’impôt sur le revenu du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1

Section 52.1 of the New Brunswick Income Tax Act,

chapter N-6.001 of the Acts of New Brunswick, 2000, is amended 1 L’article 52.1 de la Loi de l’impôt sur le revenu du Nouveau-Brunswick,

chapitre N- 6.001 des Lois du Nouveau-Brunswick de 2000, est modifié (

a) by adding after subsection (5.2) the following:

a) par l’adjonction, après le paragraphe (5.2), de ce qui suit : 52.1(5.3) An overpayment of $100 on account of an in- dividual’s liability under this Act for the 2006 taxation year is deemed to have arisen in the 2006 taxation year if 52.1(5.3) Un paiement en trop de 100 $ au

a) the individual resided in New Brunswick on De- cember 31, 2006, and has filed a return of income for the 2006 taxation year,

a) le particulier résidait au Nouveau-Brunswick le 31 décembre 2006 et a produit une déclaration de reve- nu pour l’année d’imposition 2006; (

b) the individual’s total family income for the 2006 taxation year was $28,000 or less,

b) le revenu familial total du particulier pour l’année d’imposition 2006 était égal ou inférieur à 28 000 $; (

c) the place where the individual lives is his or her principal place of residence,

c) le lieu où vit le particulier est son lieu principal de résidence; (

d) on or before June 30, 2008, the individual has, either on his or her own behalf or through a represen- tative, filed an application on the form provided by the Minister of Finance of New Brunswick for a refund of the overpayment, and

d) le 30 juin 2008 ou avant cette date, le particulier a, soit lui-même ou par l’intermédiaire d’un représentant, produit une demande de remboursement du paiement en trop au moyen de la formule fournie par le ministre des Finances du Nouveau-Brunswick; 1

e) the individual has, either on his or her own behalf or through a representative, provided all of the infor- mation required by the application form or the Minister of Finance of New Brunswick before the date required by that Minister.

e) le particulier a, soit lui-même ou par l’intermé- diaire d’un représentant, donné tous les renseignements requis par la formule de demande ou par le ministre des Finances du Nouveau-Brunswick avant la date fixée par ce ministre. 52.1(5.4) If an individual’s total family income for the 2006 taxation year was more than $28,000, if the individ- ual’s total family income for the 2007 taxation year was $28,000 or less and if the individual meets the criteria re- ferred to in paragraphs (5.3)(

a) and (

c) to (e), 52.1(5.4) Si le revenu familial total d’un particulier pour l’année d’imposition 2006 était supérieur à 28 000 $ et que son revenu familial total pour l’année d’imposition 2007 est égal ou inférieur à 28 000 $, et si le particulier répond aux conditions visées aux alinéas (5.3)
