OIC Text: The Governor in Council on the report and recommendation of the Minister of Health, dated November 23, 1998, pursuant to

Section 61 of

Chapter 208 of the Revised Statutes of Nova Scotia, 1989, the Hospitals Act, is pleased to: (

a) amend Order in Council 96-710 dated September 24, 1996, by adding the following clause immediately following clause (

c) thereof: "(

d) determine that the Province shall defend, negotiate or settle claims or charges made against a member or members of the Review Board and indemnify them from personal liability provided, however, the Province is satisfied that the claim arises out of the member's activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends."; (

b) amend Order in Council 97-316 dated June 3, 1997, by adding the following immediately following the words and symbols "April 30, 2000" appearing in the last line thereof: "; and determine that the Province shall defend, negotiate or settle claims or charges made against Dr. Patrick Flynn and indemnify him for personal liability provided, however, the Province is satisfied that the claim arises out of his activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends."; (

c) amend Order in Council 97-490 dated July 30, 1997, by adding the following clause immediately following clause (

b) thereof: "(

c) determine that the Province shall defend, negotiate or settle claims or charges made against a member or members of the Review Board and indemnify them from personal liability provided, however, the Province is satisfied that the claim arises out of the member's activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends."; (

d) amend Order in Council 98-49 dated February 3, 1998, by adding the following immediately following the words and symbols "November 30, 1998" appearing in the last line thereof: "; and determine that the Province shall defend, negotiate or settle claims or charges made against Ian Tay Landry and indemnify him from personal liability provided, however, the Province is satisfied that the claim arises out of his activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends."; and (

e) amend Order in Council 1998 433 dated August 28, 1998, by adding the following immediately following the words and symbols "July 31, 1999" appearing in the last line thereof: "; and determine that the Province shall defend, negotiate or settle claims or charges made against William H.R. Charles, Q.C. and indemnify him from personal liability provided, however, the Province is satisfied that the claim arises out of his activities in relation to the appointment and is not based on fraud or criminal activity and provided that the Province will be in control of a case which it defends.".
