Section 2.1 of the Prescription Drug Payment Act,

chapter P-15.01 of the Acts of New Brunswick, 1975, is amended 1 L’article 2.1 de la

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 2.1(1) Subject to subsection (1.1), the Minister may de- termine a drug, good or service to be an entitled service for the purposes of a programme established under this Act. 2.1(1)

b) by adding after subsection (1) the following:

a) the conditions prescribed by regulation are met, or

2.1(1.2) The Minister may revoke a determination that a drug, good or service, other than an interchangeable pharmaceutical product, is an entitled service if he or she considers it advisable to do so. 2.1(1.2) À l’exception d’un produit pharmaceutique in- terchangeable et s’il l’estime indiqué, le Ministre peut ré- voquer la désignation d’un médicament, d’un bien ou d’un service en tant que service assuré. 2.1(1.3) The Minister may revoke a determination that an interchangeable pharmaceutical product is an entitled service if 2.1(1.3) Le Ministre peut révoquer la désignation d’un produit pharmaceutique interchangeable en tant que ser- vice assuré dans l’un ou l’autre des cas suivants : (

a) he or she considers it advisable to do so, or

b) the conditions prescribed by regulation or those conditions, as varied by the Minister in accordance with the regulations, have been breached.

d) par l’adjonction de ce qui suit après le paragra- phe (3) : 2.1(4) A manufacturer shall provide the Minister with any information that the Minister requires for the purposes of determining the unit price of a drug. 2.1(4) Le fabriquant fournit au Ministre les renseigne- ments qu’il exige afin de fixer le prix unitaire d’un médi- cament. 2.1(5) The Minister shall prepare, maintain and publish a list which shall specify the unit prices of interchangeable pharmaceutical products as determined under subsection (3). 2.1(5) Le Ministre rédige, tient et publie une liste indi- quant les prix unitaires des produits pharmaceutiques in- terchangeables qui ont été fixés en vertu du paragra- phe (3). 2.1(6) For greater certainty and notwithstanding sub- sections (1.1) and (1.3), an interchangeable pharmaceuti- cal product determined by the Minister to be an entitled service that was listed on the New Brunswick Prescription Drug Program Formulary immediately before the com- mencement of this subsection continues, subject to this Act and the regulations, to be an entitled service until the Min- ister revokes the determination in accordance with this Act. 2.1(6) Il est entendu que, malgré les paragraphes (1.1) et (1.3), tout produit pharmaceutique interchangeable dé- signé en tant que service assuré par le Ministre et inscrit au Formulaire du régime des médicaments sur ordonnance du Nouveau-Brunswick immédiatement avant l’entrée en vigueur du présent paragraphe le demeure, sous réserve de la présente loi et de ses règlements, jusqu’à ce que le Mi- nistre révoque sa désignation conformément à la présente loi. 2

Section 2.11 of the Act is amended 2 L’article 2.11 de la Loi est modifié (

a) in subsection (1)

Section 5 of the Act is amended 3 L’article 5 de la Loi est modifié (

e) who, for the purpose of the eventual dispensing of an interchangeable pharmaceutical product as an enti- tled service under this Act by a participating provider, sells the drug to the participating provider for a price that is higher than its unit price listed by the Minister under subsection 2.1(5);

Section 7 of the Act is amended 4 L’article 7 de la Loi est modifié (

a) by adding after paragraph (e.2) the following:

(e.4) respecting exemptions from any condition pre- scribed under paragraph (e.3); e.4) concernant l’exemption de toute condition régle- mentaire prévue à l’alinéa e.3); (e.5) authorizing the Minister to vary any condition prescribed under paragraph (e.3) in certain circum- stances; e.5) autorisant le Ministre à modifier dans certaines circonstances toute condition réglementaire prévue à l’alinéa e.3); (e.6) respecting the circumstances referred to in para- graph (e.5), including authorizing the Minister to de- termine if the circumstances exist; e.6) concernant les circonstances visées à l’ali- néa e.5), notamment autorisant le Ministre à déterminer si ces circonstances existent; (e.7) imposing rules, terms, restrictions or conditions respecting price reductions provided to participating providers in relation to interchangeable pharmaceutical products that are entitled services; e.7) imposant des règles, des modalités, des restric- tions ou des conditions relatives aux réductions de prix offertes aux dispensateurs participants par rapport aux produits pharmaceutiques interchangeables qui consti- tuent des services assurés; (

b) by adding after paragraph (f.2) the following:
