Bill 56 BILL 56 1978 THE GAS RESOURCES PRESERVATION AMENDMENT ACT, 1978 (Assented to , 1978) HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1 The Gas Resources Preservation Act is amended by this Act. 2

Section 24(

J) is repealed and the/allowing is substituted: 24(1) Notwithstanding any other provision of this Act, the Lieutenant Governor in Council, upon the recommendation of the Board, may by general regulation or special order exclude from the application of this Act, under such condi tions as he may prescri be, any propane that is removed or that is intended to be removed from the Province by pipe line or by any other means.

(1.1) A regulation or order made under this

section (

a) does not extend the term of any permit authorizing the removal of propane from the Province (0 that was issued before the effective date of, and (ii) that would have been in effect during, the period of exclusion prescribed in the regulation or order, and (

b) may provide that when the period of exclusion is terminated, a permit that would have authorized the r~moval of propane from the Province is, on the effec tIve date of termination of the exclusion, effective to authorize the removal of propane from the Province during any unexpired portion of its term that remains after the termination of the period of exclusion. 1

Explaflatory Notes 1 This Bill will amend

chapter 157 of the Revised Statutes of Alberta 1970. 2

Section 24(1) presently reads: 24(1) Notwithstanding any other provision of this Act, the Lieutenant Governor in Council, upon the recommendation of the Board, may, by general regulations or special orders, (

a) exclude ./i"om the application of this Act, under such conditions as may be prescribed, any propane that is removed or that is intended to be removed from the Province otherwise than by means of pipe lines; (

b) exclude ./i"om the application of this Act, upon application and for a period of not more than 12 months and subject to such conditions as may be prescribed, any propane that is removed or that is intended to be removed ./i"om the Province by pipe line. 1
