B.C. Reg. 381/2003, deposited October 24, 2003, pursuant to the MOTOR CARRIER ACT [Section 39 (7)]. Order in Council 1010/2003, approved and ordered October 23, 2003.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that approval is given to the Motor Carrier Commission to make the attached regulation. — J. REID, Minister of Transportation; J. van DONGEN, Presiding Member of the Executive Council.

With the approval of the Lieutenant Governor in Council:

1 The Inspectors' Powers Regulation, B.C. Reg. 62/91, is repealed.

2 The Motor Carrier Act Regulation, B.C. Reg. 311/2003, is amended

(

a) by adding the following section:

Exemption for the Greater Vancouver Transportation Authority

2.1

(1) In this section:

"Authority" means the Greater Vancouver Transportation Authority established under the

Greater Vancouver Transportation Authority Act ;

"transportation service region" means a transportation service region as defined in the

Greater Vancouver Transportation Authority Act .

(2) The provisions of the Act and this regulation do not apply to the following:

(

a) a passenger vehicle owned by the Authority while being operated within the boundaries of the transportation service region;

(

b) a passenger vehicle providing public transit service that is funded in whole or in part by the Authority, including a vehicle operating under contract to the Authority. ,

(

b) by repealing

section 48 (2) and substituting the following:

(2) The applicant must deposit security for costs of the hearing according to

Schedule 2 in the form and by the date directed by the commission. , and

(

c) in

section 49 (2) by striking out "within 21 days" and substituting "at least 21 days".

3 The attached Community Care Facility Exemption Regulation is made.

COMMUNITY CARE FACILITY

EXEMPTION REGULATION

Exemption of motor vehicles

1 A motor vehicle is exempt from the application of the

Motor Carrier Act if

(

a) the Motor Carrier Act would otherwise apply to it because it is used by a community care facility as defined in

section 1 of the

Community Care Facility Act , and

(

b) the motor vehicle is used in no other way to which the

Motor Carrier Act applies except by the community care facility.

Exemption of persons

2 A person is exempt from the application of the

Motor Carrier Act if the Motor Carrier Act would otherwise apply to the person solely because of a motor vehicle described in

section 1, assuming

section 1 did not exempt the motor vehicle from the

Motor Carrier Act .

Repeal

3 This regulation is repealed on the day the

Community Care and Assisted Living Act , S.B.C. 2002, c. 75, comes into force.
