Cape Smokey Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 9th day of March, A.D., 1983, and pursuant to

Section 2 of

Chapter 244 of the

Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to:

(

a) constitute all that area of land situate at Cape Smokey, in the County of

Victoria, owned by Her Majesty the Queen in right of the Province of Nova

Scotia, to be a Provincial Park, the said area of land being described in

Schedule “A” and shown outlined in red on the copy of Crown Land Records

Plan No. E-13-37 marked

Schedule “B”, both Schedules attached to and

forming part of the report and recommendation; and

(

b) declare that the park shall be known by the name of “Cape Smokey Provincial

Park”.

Schedule “A”

All that certain lot, piece or parcel of land situate, lying and being at Cape Smokey, in the

County of Victoria, Province of Nova Scotia as shown on Plan No. E-13-37 filed in the Crown

Land Records Office, Department of Lands and Forests, Halifax, the said land being more

particularly described as follows:

Beginning at the point of intersection of the easterly boundary of the Cabot Trail and a

southerly boundary of Crown Grant No. 15727, lands now or formerly of Angus McKay;

Thence N 61° 05' E (by magnetic bearings in the year 1963), 240 feet more or less along said

southerly boundary of Grant No. 15727 to Survey Marker (S.M.) No. V2000;

Thence continuing along a southerly boundary of said Grant No. 15727, S 57° 25' E, 363.0 feet

to S.M. No. V2001;

Thence continuing along a southerly boundary of said Grant No. 15727, N 61° 05' E, 877.8 feet

to S.M. No. V2002 situated at the southeasterly angle of said Grant No. 15727 and also situated

on the westerly boundary of lands now or formerly occupied by Donald McLeod;

Thence S 28° 55' E, following the westerly boundary of lands now or formerly occupied by

Donald McLeod, 330 feet more or less to the westerly boundary of a brook;

Thence following the various courses of the westerly boundary of said brook at the ordinary

high water mark in a southeasterly direction, 6200 feet more or less until it meets the ordinary

high water mark of the Atlantic Ocean;

Thence following the various courses of the ordinary high water mark of the Atlantic Ocean in

a southwesterly direction, 6000 feet more or less to the northeasterly angle of lands now or

formerly occupied by Malcolm MacLeod;

Thence N 47° 00' W, 200 feet more or less along the northeasterly boundary of said lands now

or formerly occupied by Malcolm MacLeod to S.M. No. V939;

Thence continuing along said northeasterly boundary of lands now or formerly of Malcolm

MacLeod, N 47° 00' W, 854 feet more or less to the easterly boundary of the aforementioned

Cabot Trail;

Thence following the various courses along the easterly boundary of the said Cabot Trail in a

northerly direction, 9600 feet more or less to the point of beginning, containing 417 acres more

or less.

Excepting and reserving therefrom a parcel of land utilized as a microwave tower site, said

parcel of land being more particularly described as follows:

Beginning at a point designated as Point “A” shown on aforementioned Plan No. E-13-37;

Thence (by astronomic bearings) N 89° 48' E, 192.0 feet to Point “B”;

Thence S 15° 57' E, 211.8 feet to Point “C”;

Thence N 82° 52' W, 249.0 feet to Point “D”;

Thence N 01° 02' W, 172.1 feet to the point of beginning, containing 0.94 acres more or less.

Together with an access road 20 feet wide and being more particularly described as follows:

Beginning at a point on the centreline of the said access road, said point situated also on the

easterly boundary of the aforementioned Cabot Trail;

Thence S 67° 30' E following the centre line of the said access road 26.4 feet until it intersects

the westerly boundary of the above described parcel of land at a point being S 01° 02' E, 14.05

feet from the aforedescribed Point “A”, and embracing a width of 10 feet at right angles to and

on either said of the said centre line, said access road containing an area of 0.01 acres, more or

less.

The Governor in Council on the report and recommendation of the Minister of Natural

Resources dated December 3, 2015, and pursuant to

Section 8 of

Chapter 367 of the Revised

Statutes of Nova Scotia, 1989, the Provincial Parks Act , is pleased, effective on and after

December 29, 2015, to:

(

a) increase the size of Cape Smokey Provincial Park, originally designated by the

Governor in Council by Order in Council 83-318 dated March 29, 1983, by

adding existing Crown lands shown outlined in bold on the plan marked

Schedule “A” attached to and forming part of the report and recommendation;

and

(

b) authorize the Minister of Natural Resources to execute such documents as may

be necessary to achieve the purposes of this Order.
