B.C. Reg. 6/2008 , deposited January 11, 2008, pursuant to the EMPLOYMENT AND ASSISTANCE ACT [Section 35 (2) (

c) and (4)] and the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26 (2) (

d) and (4) (c)]. Order in Council 10/2008 approved and ordered January 10, 2008.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Employment and Assistance Regulation, B.C. Reg. 263/2002, and the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, are amended as set out in the attached Appendix.

Appendix

Section 4.1 of the Employment and Assistance Regulation, B.C. Reg. 263/2002, is amended

(

a) by repealing subsection (4) (f), and

(

b) by adding the following subsection:

(5) Subsection (2) (

b) does not apply if any person in the family unit to which an application relates has an immediate need for food or shelter or needs urgent medical attention.

Section 4.1 of the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended

(

a) by repealing subsection (4) and substituting the following:

(4) Subsection (2) (

b) does not apply to a person who

(

a) is prohibited by law from working in Canada,

(

b) has reached 65 years of age,

(

c) is a person with disabilities,

(

d) is not a person with disabilities, but has a physical or mental condition that, in the minister's opinion, precludes the person from completing a search for employment as directed by the minister, or

(

e) is fleeing an abusive spouse or relative. , and

(

b) by adding the following subsection:

(5) Subsection (2) (

b) does not apply if any person in the family unit to which an application relates has an immediate need for food or shelter or needs urgent medical attention.
