General information about corrections and minor changes
The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors.
Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of
an Act or regulation without changing its legal effect.
Notice of the following types of minor changes must be given:
replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a
chapter number; [s. 25(2)(g)]
removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
updating a reference to a person, office, organization, place or thing if
an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
a change in the title of a minister or the name of a department; [s. 25(2)(j)]
updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act , the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
correcting an error in the numbering of a provision or other portion of
an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
removing a provision that is deemed by The
Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

DEFINITIONS
DÉFINITIONS
Definitions
1 In this regulation,
"Act" means The Health Services Insurance Act ; (« Loi »)
"assessment panel" means a person or group of persons designated by the minister for the purpose of assessing a person's need for personal care in a personal care home or chronic care in a hospital; (« comité d'évaluation »)
"board" means the Manitoba Health Appeal Board established under
section 9 of the Act; (« Conseil »)
"common-law partner" in relation to an insured person, means a person who, not being married to the insured person, cohabitated with the insured person in a conjugal relationship for at least one year immediately before the insured person's admission to a health facility; (« conjoint de fait »)
"family registrant" means a person who has registered with the minister in his or her own name and on behalf of one or more of his or her resident dependants; (« chef de famille »)
"in-patient services" means the hospital services set out in
Schedule A that are not excluded under the Excluded Services Regulation , Manitoba Regulation 46/93, made under the Act; (« services en hôpital »)
"nurse practitioner" means a registered nurse (nurse practitioner) under the College of Registered Nurses of Manitoba General Regulation , Manitoba Regulation 114/2017; (« infirmière praticienne »)
"out-patient services" means the hospital services set out in
Schedule B that are not excluded under the Excluded Services Regulation made under the Act; (« soins en consultation externe »)
"practitioner" means a physician, nurse practitioner, midwife or licensed dentist; (« praticien »)
"separated" in relation to an insured person, means an insured person living separate and apart from his or her spouse or common-law partner because of a breakdown in their relationship and not because of a medical necessity; (« séparé »)
"spouse" , in relation to an insured person, means a person to whom the insured person is married. (« conjoint »)

Entitlement to hospital services
2 An insured person who has been admitted to a hospital in Manitoba as an in-patient or an out-patient on the order of
(
a) a physician, nurse practitioner or midwife; or
(
b) subject to
section 3, a licensed dentist;
is entitled to receive in-patient services or out-patient services as a benefit under the Act without paying any charge to the hospital other than the authorized charges referred to in sections 7, 8 and 9.

Dental services in a hospital
3(1) Subject to subsection (2), an insured person is entitled to receive, as an in-patient or an out-patient, the dental services described in
Schedule C without paying any charge to the hospital for the in-patient or out-patient services.

Determination of hospital stay
6(1) To determine the period of time for which an insured person is entitled to in-patient services, the minister may require a hospital to secure from the attending practitioner and forward to the minister a written statement regarding the patient's condition and the reason or necessity for the patient receiving in-patient services during all or any part of the patient's stay in hospital.

6(2) If in the opinion of the minister a doubt exists concerning the necessity for continuing in-patient services, the minister may designate a physician, nurse practitioner or midwife to investigate and report on the case.
6(2) S'il a des doutes quant à la nécessité de poursuivre les services en hôpital, le ministre peut désigner un médecin, une infirmière praticienne ou une sage-femme pour évaluer le cas et en faire rapport.
6(3) If in the opinion of the physician, nurse practitioner or midwife referred to in subsection (2) the in-patient services are not required, the minister shall cease to pay for in-patient services in accordance with the report of the physician, nurse practitioner or midwife and shall notify the hospital of the date on which payments will cease.

Authorized charges for services not medically required
7(1) If the minister determines that services provided by a hospital to an insured person
(
a) are not medically required; or
(
b) are not in-patient or out-patient services to which an insured person is entitled under
section 2 or 3;
the hospital may make a daily authorized charge to the insured person equal to the per diem rate of payment approved by the minister.

7(2) Notwithstanding subsection (1), if in-patient services are not medically required but are provided to an insured person who meets the criteria for short-term respite care in a hospital, the hospital shall make an authorized charge to the insured person of $43.10 per day effective August 1, 2025.

7(2) Par dérogation au paragraphe (1), l'hôpital facture quotidiennement à l'assuré 43,10 $ à compter du 1 er août 2025 si les services en hôpital ne sont pas nécessaires du point de vue médical, mais sont fournis à un assuré qui répond aux critères de soins de convalescence hospitaliers de courte durée.

Basic authorized charges for persons needing personal care
7.1(1) If in-patient services are not medically required but are provided to an insured person whose need for placement in a personal care home has been determined by the assessment panel, the hospital shall make an authorized charge to the person of $104.20 per day, subject to any reduction available under
section 7.2.

7.1(2) If a personal care bed is made available to an insured person described in subsection (1) and he or she has refused to accept it, the hospital may, instead of the authorized charge referred to in that subsection, make an authorized charge to the person equal to the per diem rate of payment approved by the minister.

Income-based reduction in authorized charges
7.2(1) When the net income of an insured person who is single, widowed, separated or divorced is an amount set out in Column 1 of
Schedule B to the Personal Care Services Insurance and Administration Regulation , Manitoba Regulation 52/93, the insured person is entitled to have the authorized charge under subsection 7.1(1) reduced to the amount set out opposite the person's net income in Column 3.

7.2(3.1) If an insured person is required to pay service fees to the Public Trustee because the Public Trustee is the person's committee or substitute decision-maker for property, the amount of the reduction in the authorized charge under this
section is to be adjusted as follows:
1. If the insured person's net income is between $21,961.07 and $45,561.98, that income is to be reduced by 5.66038% for the purpose of calculating the reduction under subsection (1) or (2).
2. If the insured person has a spouse or common-law partner who resides outside of a health facility and the spouses' or common-law partners' combined net income is between $66,853.07 and $89,157.98, that income is, for the purpose of calculating the reduction under subsection (3), to be reduced by an amount equal to 5.66038% of the combined net income minus $44,892.

7.2(4) An insured person entitled to a reduction under this
section must apply for the reduction to the minister or, with the approval of the minister, to the hospital or health facility in which he or she resides.

Review of authorized charges
7.3(1) If an insured person is unable to pay an authorized charge under subsection 7.1(1) because of extenuating circumstances, he or she may request the minister to review the amount of the authorized charge.

7.4(1) If an insured person is not satisfied with the outcome of a review under
section 7.3 he or she may appeal the amount of the authorized charge calculated under subsection 7.1(1) and
section 7.2 to the board.

Authorized charges for chronic care patients
8(1) In this section, "chronic care patient" means an insured person who
(
a) lives more or less permanently in a hospital;
(
b) has reached his or her maximum level of functional ability and shows little or no potential for improvement; and
(
c) requires a level of care or special treatment that cannot be provided either at home with supports or within the personal care home program.

8(2) The hospital may make an authorized charge to a chronic care patient in the amount determined in accordance with subsection 7.1(1) and
section 7.2 if
(
a) acute care services are not medically required by the patient; and
(
b) the patient's need for personal care in a hospital has been established to the satisfaction of an assessment panel or, in the absence of an assessment panel, the attending physician.

Waiver — spouse or common-law partner living in the community
8.1(1) Notwithstanding any other provision of this regulation, the minister may waive payment of all or part of an authorized charge payable by an insured person under subsection 7.1(1) or
section 8 in order to ensure that the spouse or common-law partner of the insured person does not suffer undue financial hardship, but only if the following conditions are met:
(
a) the spouse or common-law partner must reside outside a health facility;
(
b) the combined net income of the insured person and his or her spouse or common-law partner must be less than $41,100 plus $8,500 for each dependant of the insured person residing outside a heath facility; and
(
c) the insured person and his or her spouse or common-law partner must have attempted to obtain income from all sources for which they are eligible, including but not limited to income assistance, Old Age Security and the Guaranteed Income Supplement.

9 If an insured person is entitled to receive insured services under
section 3 and the two days referred to in subsection 3(2) have elapsed, a hospital may make a daily authorized charge to the insured person that is equal to the rate approved by the minister.

a) in respect of semi-private accommodation, $97.00 per day;

11 If the attending physician, nurse practitioner or midwife certifies that an insured person's condition is such that he or she requires emergency admission as an in-patient, and standard accommodation is not available in the hospital, or if the attending physician, nurse practitioner or midwife certifies that the insured person is an isolation case or is in such a condition that he or she requires private or semi-private accommodation, the hospital shall not make any charge to the patient for private or semi-private accommodation unless that accommodation was requested by or on behalf of the insured person.

In-patient hospital services
14 Subject to sections 15 to 23, where an insured person receives in-patient services in a hospital outside Manitoba, the minister may
(
a) reimburse the insured person for all or part of the cost of the in-patient services received on presentation to the minister of a detailed receipt from the hospital for payment made to the hospital by the insured person; or
(
b) make payment directly to the hospital for the in-patient services received by the insured person.

Limitation
15(1) It is a condition of payment for in-patient services under
section 14 that,
(
a) the hospital that supplied the services
(ii) is the type of institution that in the opinion of the minister properly falls in the category of an active treatment hospital as that term is understood and applied by the minister to hospitals in Manitoba, and
(iii) is not an institution associated with a mineral spring or spa;
(
b) the minister receives from the hospital which provided the services a certified statement that shows,
(
i) that the patient was admitted by a practitioner,
(ii) the diagnosis of the condition for which the patient was admitted,
(iii) the date of admission and the date of discharge or death of the patient,
(iv) the nature of complications or sequelae, if any, that would explain a longer than average stay in hospital for a person with the disease or condition diagnosed,
(
v) the nature of any special treatment procedures or surgery that were performed on the patient,
(vi) the discharge diagnosis or cause of death, as the case may be, and
(vii) such other information as may be requested by the minister;
(
c) in any case where the in-patient services continued beyond a period of 30 days, the minister was notified of that fact in writing not later than the 40th day following admission; and
(
d) a claim is submitted within six months of the date of separation or discharge.

15(2) The minister may extend the time referred to in clause 1(
d) if in the minister's opinion there are extenuating circumstances that prevented the filing of the claim within the six-month period.

Payment for in-patient services
16(1) Where in-patient services are provided in a hospital in a participating hospital province, the amount payable shall be in accordance with the rates approved by the provincial authority in that participating hospital province.

(c) 75% of the hospital charges for the in-patient services; and
(
d) a per diem rate of payment as follows:
(
i) for a newborn, $150.00,
(ii) for other insured persons, a rate based on the number of beds in the hospital in which the services are provided, as set out below:

Where in-patient services no longer required
17 Where the minister, after such inquiries and on such evidence as the minister may require, determines that an insured person receiving in-patient services in a hospital outside Manitoba no longer requires those in-patient services, the minister shall notify the insured person and the hospital of the determination and the minister shall not make any payment to the hospital or to the insured person for in-patient services received after the date specified in the notification.

Out-patient hospital services
18(1) Where out-patient services are provided to an insured person in a hospital in a participating hospital province, the minister may reimburse the insured person or make a direct payment to the hospital in accordance with the rates approved by the provincial authority in that participating hospital province.

the minister shall reimburse the insured person or make payment directly to the hospital in an amount which is the greater of
(c) 75% of the actual hospital charges for the insured out-patient services; and
(d) $62.00 per visit.

Minister may increase amount
19 Upon receipt of an application in a form and manner as the minister may require, the minister may pay amounts greater than the amounts otherwise payable in respect of services that meet the requirements set out in subsection 16(2) or clause 18(2)(
b) if in the minister's opinion it is fair and reasonable to do so having regard to the services provided and the financial circumstances of the insured person.

Dental services in a hospital
20(1) Where an insured person receives, as an in-patient or an out-patient, the dental services described in
Schedule C outside of Manitoba but within Canada, the amount payable is an amount up to but not exceeding the amount that is approved by the Health Care Insurance Plan of the province in which the services are provided, but if there is an agreement that apportions cost between the respective Health Care Insurance Plans in a different manner, then payment shall be made in accordance with the agreement.

Payment conditional on receipt or account
21(1) It is a condition of payment for insured dental services provided outside of Manitoba that within six months from the date upon which the services were provided the insured person submit to the minister an itemized receipt or account that shows the services provided and the fees paid or payable.

Services for the mentally ill
22(1) Where in-patient services are provided to an insured person in a psychiatric hospital outside a participating hospital province and the hospital is approved by the minister, the amount payable is $240.61 per day for a period of not more than 60 days in a calendar year.

25(1) Every hospital in Manitoba shall keep and maintain such books and records as will comply with the established and recognized accounting procedures and practices for hospitals, and such particular books and records as the minister and the health authority that provides operational funding to the hospital may require in writing.

The basis for hospitalization is determined by dental necessity, the medical status of the patient, or both.

3. Surgical removal of any teeth or other oral/dental surgical procedure in hospital where such treatment is an integral part of the management or treatment of a specific systemic condition or trauma, and such oral/dental surgical procedure has been requested by the patient's attending physician.

DIVISION 3
1 In this Division and in Division 2 of
Part 2, "impacted tooth" means a tooth that
(
a) is completely or partially unerupted and positioned against another tooth, bone or soft tissue so that further eruption is unlikely; or
(
b) fails to move into position and function within a reasonable length of time.
2(1) Surgical removal of impacted teeth, including hospital costs, is an insured service when performed by a certified oral and maxillofacial surgeon or a licensed dentist, if the following conditions are met:
(
a) the surgeon or dentist provides a statement and supporting information, including X-rays where appropriate, acceptable to the minister that the procedure is a dental necessity and that
(
i) hospital facilities are required for the proper performance of the procedure, or
(ii) a pre-existing medical condition requires in-hospital monitoring of the insured person during the peri-operative period; and
(
b) the minister approves the procedure in writing before it is performed.
2(2) In determining whether a procedure is a dental necessity under clause (1)(a), the minister shall consider whether
(
a) there is a significant risk to the insured person's oral health resulting from
(
i) infection,
(ii) a non-restorable carious lesion,
(iii) a cyst,
(iv) a tumour,
(
v) destruction of adjacent teeth and bone,
(vi) local pain that is continuous, such that it impairs the insured person's functioning, or
(vii) other criteria that the minister considers appropriate; or
(
b) the procedure is necessary for the safe completion of another insured oral surgical procedure, including fracture treatment and osteotomy.
2(3) In subclause (1)(a)(ii), "pre-existing medical condition" includes:
(
a) Central Nervous System Disorders:
(
i) significant disability due to cerebrovascular accident,
(ii) epilepsy or seizures that are difficult to control,
(iii) significant cerebral palsy, myasthenia gravis, muscular dystrophy,
(iv) significant Alzheimer's Disease,
(
v) other forms of active central nervous disorders where there is loss of sensory, motor or autonomic function under medical treatment;
(
b) Cardiovascular Disorders:
(
i) significant disability due to myocardial infarction,
(ii) unstable angina on active treatment,
(iii) unstable, significantly elevated hypertension on active treatment,
(iv) significant congestive heart failure,
(
v) other forms of unstable cardiac disease under active treatment,
(vi) other cardiovascular disorders under treatment, including situations requiring extractions prior to cardiovascular surgery;
(
c) Respiratory Disorders:
(
i) unstable pulmonary disease under active management;
(
d) Renal Disorders:
(
i) unstable renal disease under active management;
(
e) Hematologic Disorders:
(
i) leukemias under chemotherapy,
(ii) hemophilias or other bleeding diathesis,
(iii) anemia with hemoglobin less than 10 grams %,
(iv) other unstable hematologic disorders under active management;
(
f) Hepatic Disorders:
(
i) hepatitis A, hepatitis B, non A non B hepatitis,
(ii) other significant hepatic diseases under active management;
(
g) Endocrine Disorders:
(
i) hypothalmic and pituitary disorders requiring steroid therapy,
(ii) insulin-dependent diabetes mellitus requiring monitoring of blood glucose,
(iii) other unstable endocrine disorders under active management;
(
h) Neoplastic Disorders:
(
i) active cancer treatment, chemotherapy or radiotherapy,
(ii) other unstable neoplastic disorders under active treatment;
(
i) Viral, Non Viral, Bacterial, Infectious or Immune Deficiency States:
(
i) active herpes simplex,
(ii) A.I.D.S.,
(iii) other unstable infectious disorders under active treatment;
(
j) Metabolic Disorders:
(
i) malignant hyperthermia,
(ii) other significant metabolic disorders under active treatment;
(
k) Other Disorders or Conditions:
(
i) proven allergy to local anaesthetics,
(ii) pre-radiation of the head and neck, including situations involving extractions prior to radiation treatment,
(iii) post-radiation necrosis or sepsis,
(iv) expectation of difficulty in anaesthetizing patient,
(
v) significant mental illness or incompetence,
(iv) significant disability due to age or infirmity;
(
l) Other conditions for which hospitalization may be necessary, which will be given independent consideration.

DIVISION 4
Periodontal surgery, including hospital cost, is an insured service when performed by a certified periodontist or a certified pedodontist.
DIVISION 5
In addition to hospital costs referred to in Divisions 1 to 4, hospital costs are insured services when a person is admitted for one of the following reasons:
1. The removal of 10 or more permanent teeth.
2. The removal of any teeth where hospitalization is required because of a systemic condition or trauma.
3. The extraction of six or more deciduous teeth.
4. Post-operative complication of dental origin.
5. When in the opinion of the surgeon or dentist hospitalization is required for the proper performance of the procedure because the patient requires general anaesthetic and is either under 12 years of age, or is mentally incapacitated or physically incapacitated.
Insured hospital services for dental care shall not be continued for more than two days without a further admission order by a physician or a certified oral and maxillofacial surgeon.

PART 2
BENEFITS
DIVISION 1
RULES OF APPLICATION FOR ORAL SURGERY BENEFITS
The rules of application in respect of the cost of insured dental services are set out in this Division.
RULES OF APPLICATION
1. Benefits for procedures involving the removal of two or more IMPACTED OR UNERUPTED TEETH shall be 100% of the benefit for the first tooth in a quadrant and 75% of the
schedule of benefits for the first tooth in other quadrants. Where the second tooth is in the same quadrant and removed through the same incision as the first tooth, the benefit shall be 75% of the
schedule of benefits.
Where the second tooth is in the same quadrant but removed through a separate incision from the first tooth, the benefit shall be 75% of the
schedule of benefits for the second tooth in a quadrant.
2. Benefits for BILATERAL PROCEDURES in separate quadrants performed in separate hospital admissions or at separate operative sessions shall be provided at the full scheduled benefit. When done during the same operative session, utilizing the same anaesthetic, the benefit shall be 100% of the scheduled benefit in the first quadrant and 75% of the scheduled benefit for each successive quadrant except in those circumstances where the procedures are performed by certified periodontist in which case the full benefit will be applicable.
3. In MULTIPLE SURGICAL PROCEDURES, performed through the same incision by the same surgeon or his assistant, benefits shall only be provided for the major procedure, except under exceptional circumstances and by special report, when benefits for the lesser procedure(
s) may be provided at 50% of the benefit under the schedule.
4. When two or more UNRELATED PROCEDURES are done by the same surgeon or his assistant through separate incisions, but utilizing the same anaesthetic, the benefit provided for the major procedure shall be 100% of the benefit under the
schedule and for the minor or other procedure(s) 75% of the benefit under the schedule.
5. When two or more UNRELATED PROCEDURES are done through separate incisions by two surgeons in different specialties, the benefit provided for each procedure shall be 100% of the benefit under the schedule.
6. Benefits for SURGICAL PROCEDURES include six weeks post-operative care.
7. POST-OPERATIVE SURGICAL CARE is the responsibility of the surgeon. However, under exceptional circumstances, e.g., being out of town, or being confined by illness, the surgeon may delegate this work to another dentist, whereupon the benefit shall be apportioned, 85% applicable to the service performed by the surgeon and 15% applicable to the work performed by the physician/oral surgeon responsible for the post-operative care.
8. Benefits for ADDITIONAL SURGICAL PROCEDURES which are performed within six weeks of, but not directly related to, a preceding operation shall be provided at the full
schedule benefit.
9. When TWO SURGEONS are involved in the management of a surgical case, by prior agreement, the total benefit may be apportioned in relation to the responsibility taken and the work done, and the patient should be made aware of such apportionment.
10. The benefits for FRACTURES include care for a period of six weeks, but do not include the cost of material.
SURGICAL ASSISTANTS
11. "Assistant" is defined as a certified oral and maxillofacial surgeon who assists the surgeon throughout the duration of the operation.
12. Where hospital regulations or medical judgment require the presence of a physician/oral surgeon as surgical assistant, the appropriate benefit shall be provided.
CONSULTATIONS
13. A consultation is the situation in which a physician, after appropriate examination of the patient, requests the opinion of a certified oral and maxillofacial surgeon because of the complexity, or seriousness of the patient's dental condition. After the consultation the patient is returned to the care of the attending physician.
If the consulting certified oral and maxillofacial surgeon continues in the treatment of the dental condition, it becomes a referral, and the consultation fee will not apply.
A consultation shall consist of a complete history and examination of the patient appropriate to the consultant's field of practice and a written opinion regarding diagnosis and recommendation as to treatment.
One consultation shall be paid for the same condition to the same consulting certified oral and maxillofacial surgeon unless there are new complications requiring further consultation. These may be paid on submission of a special report.
HOSPITAL CARE
13.1 Hospital Care applies to the care of registered bed patients formally admitted to hospital by a licensed dentist for the control of infection, benefits for which are listed in
Part 2 Division 2 and are claimable from the date of admission to the date of medical discharge. Only one visit per day, per patient will be paid for in-hospital care regardless of the necessity for multiple visits on the same day.
AFTER-HOURS PREMIUM
13.2 After-Hours Premiums shall be payable for urgent or emergent services provided on weekdays, weekend days and statutory holidays as listed in
Part 2 Division 2.
BY REPORT
14. It is not possible to list every variation of a procedure. Some procedures may vary from minor to major and cannot be listed with a specific benefit, and will require assessment.
In order to correctly assess a fee tariff item designated as "By Report", the assessor must have complete information. This will include a copy of the operating room report, and pathology report if requested as well as any other information which may assist in the assessment.
Where possible, the claimant may relate the services to an existing item of similar complexity which carries a definite benefit or may suggest a suitable benefit. If you are in disagreement with an assessment, please refer to the appeal mechanism.
APPEAL MECHANISM
15. The assessment of a claim is not necessarily final and is subject to appeal. It should be recognized, however, that an unsatisfactory assessment may be the result of a misunderstanding or lack of information. An initial enquiry with the Manitoba Health claims staff may resolve the assessment to your satisfaction.
In the event that a claim assessment cannot be satisfactorily resolved after the initial contact, we suggest you submit a written request for reconsideration of your claim to the Chairman of the Dental Review Committee. The decision of the Dental Review Committee shall be final.

2 The amount of the benefit to be paid in respect of the cost of insured dental services in cases of cleft lip and/or palate for persons registered under the program by their 18th birthdate, when provided by a licensed dentist shall be the Fee Guide approved by the Manitoba Dental Association and the minister.
3 The amount of the benefit to be paid in respect of the cost of insured services in cases of significant congenital or hereditary dysplasia involving teeth and/or supporting structures, for persons registered under the Cleft Lip/Palate Treatment and Rehabilitation Program by their 18th birthday when provided by or under the direction of a dental specialist registered with the Manitoba Dental Association, shall be the same as the fees provided under sections 1 and 2 of this Division.

SERVICES DENTAIRES DANS LES HÔPITAUX
Les services énumérés dans la présente
annexe sont des services assurés lorsqu'ils sont rendus dans un hôpital par un chirurgien bucco-dentaire et maxillo-facial agréé ou par un dentiste qui juge que l'hospitalisation est nécessaire au succès de l'intervention. La nécessité de l'hospitalisation est établie en raison de la nature de l'acte dentaire ou de l'état de santé du client, ou des deux.

1 Les interventions chirurgicales énumérées ci-après, y compris les frais d'hospitalisation, sont des services assurés lorsqu'elles sont pratiquées par un chirurgien bucco-dentaire et maxillo-facial agréé :
1. excision d'un kyste intra-buccal;
2. traumatismes des tissus mous à l'intérieur et autour de la bouche;
3. incision et drainage d'un abcès d'origine dentaire (à l'extérieur ou à l'intérieur de la bouche);

SECTION 2

2. en cas d'urgence et à la demande expresse d'un médecin, les actes qui suivent sont assurés :

3. extraction chirurgicale d'une dent ou autre intervention chirurgicale bucco-dentaire pratiquée dans un hôpital, pourvu que l'intervention fasse
partie intégrante du traitement d'un état général ou d'un traumatisme particulier, et que l'intervention chirurgicale bucco-dentaire ait été faite à la demande expresse du médecin traitant de l'assuré.

SECTION 3
1 Pour l'application de la présente
section et de la
section 2 de la
partie 2, « dent enclavée » s'entend d'une dent :
a) dont l'éruption ne s'est pas produite ou ne s'est produite que partiellement et qui appuie contre une autre dent, contre un os ou du tissu mou de sorte que l'éruption ne progressera probablement pas davantage;
b) qui n'atteint pas sa position normale et n'arrive pas à fonctionner dans un délai raisonnable.
2(1) L'extraction chirurgicale d'une dent enclavée, y compris les frais d'hospitalisation, est un service assuré lorsqu'elle est pratiquée par un chirurgien bucco-dentaire et maxillo-facial agréé ou un dentiste pourvu que les conditions qui suivent soient remplies :
a) le chirurgien ou le dentiste fournit une déclaration et les renseignements à l'appui, y compris, s'il y a lieu, les radiographies connexes, de sorte que le ministre soit en mesure de déterminer si l'intervention est un soin dentaire indispensable et si :
(
i) l'intervention ne peut être pratiquée de façon convenable sans le recours aux structures hospitalières,
(ii) l'état pathologique antérieur de la personne nécessite le contrôle en hôpital de l'assuré pendant la période péri-opératoire;
b) le ministre autorise l'intervention avant qu'elle ne soit pratiquée.
2(2) Afin de déterminer si l'intervention est un soin dentaire indispensable aux termes de l'alinéa (1)a), le ministre tient compte des circonstances suivantes :
a) l'état bucco-dentaire de l'assuré sera vraisemblablement compromis par l'un des facteurs suivants :
(
i) une infection,
(ii) une lésion carieuse non réparable,
(iii) un kyste,
(iv) une tumeur,
(
v) la destruction d'une dent et d'un tissu osseux avoisinant,
(vi) la présence d'une douleur continue qui empêche l'assuré de fonctionner normalement,
(vii) d'autres facteurs que le ministre juge pertinents;
b) l'intervention est nécessaire pour qu'une autre intervention chirurgicale bucco-dentaire puisse être pratiquée sans risque, y compris le traitement d'une fracture ou une ostéotomie.
2(3) Pour l'application du sous-alinéa (1)a)(ii), « état pathologique antérieur » s'entend notamment :
a) de certains troubles du système nerveux central :
(
i) invalidité grave attribuable à un accident vasculaire cérébral,
(ii) crises d'épilepsie difficiles à stabiliser,
(iii) infirmité motrice cérébrale, myasthénie grave ou dystrophie musculaire avancée,
(iv) maladie d'Alzeimer avancée,
(
v) d'autres formes de troubles évolutifs du système nerveux qui entraînent une perte des fonctions sensorielles ou motrices ou une dystonie neuro-végétative et qui font l'objet d'un traitement médical;
b) de certains troubles cardio-vasculaires :
(
i) invalidité grave attribuable à un infarctus du myocarde,
(ii) angor instable sous traitement actif,
(iii) hypertension artérielle instable et sensiblement élevée sous traitement actif,
(iv) insuffisance cardiaque grave,
(
v) d'autres formes de cardiopathie instable sous traitement actif,
(vi) d'autres troubles cardio-vasculaires sous traitement, y compris les cas où une extraction doit être faite avant toute chirurgie cardio-vasculaire;
c) de certaines affections des voies respiratoires :
(
i) bronco-pneumopathie instable sous traitement actif;
d) de certaines affections rénales :
(
i) maladie rénale instable sous traitement actif;
e) de certaines hémopathies :
(
i) leucémie sous chimiothérapie,
(ii) hémophilie ou autre diathèse hémorragique,
(iii) anémie avec une teneur en hémoglobine inférieure à 10 grammes %,
(iv) d'autres hémopathies instables sous traitement actif;
f) de certaines affections du foie :
(
i) hépatite A, hépatite B, hépatite non A, non B,
(ii) d'autres affections graves du foie sous traitement actif;
g) de certains troubles endocriniens :
(
i) affections hypothalamiques et pituitaires nécessitant la thérapie aux stéroïdes,
(ii) diabète sucré nécessitant l'utilisation d'insuline et le contrôle de la glycémie,
(iii) d'autres troubles endocriniens sous traitement actif;
h) de certains néoplasmes :
(
i) traitement actif d'un cancer, chimiothérapie ou radiothérapie,
(ii) d'autres néoplasmes sous traitement actif;
i) de certaines maladies virales, non virales, bactériennes, infectieuses et immuno-déficitaires :
(
i) herpès évolutif,
(ii) S.I.D.A.,
(iii) d'autres maladies infectieuses instables sous traitement actif;
j) de certains désordres métaboliques :
(
i) hyperthermie maligne peranesthésique,
(ii) d'autres désordres métaboliques graves sous traitement actif;
k) d'autres désordres ou affections :
(
i) allergie avérée aux anesthésiques locaux,
(ii) pré-radiation de la tête et du cou, y compris les cas nécessitant des extractions avant le traitement par radiation,
(iii) nécrose ou septicémie consécutive à la radiation,
(iv) difficulté prévue à anesthésier le patient,
(
v) troubles mentaux ou impéritie graves,
(vi) invalidité grave causée par l'âge ou l'infirmité;
(
l) des autres affections pour lesquelles l'hospitalisation peut être nécessaire et qui sont examinées séparément.

SECTION 4
La chirurgie périodontique, y compris les frais d'hospitalisation, est un service assuré lorsqu'elle est pratiquée par un périodontiste ou un pédodontiste.
