B.C. Reg. 259/2001, deposited November 7, 2001, pursuant to the INSURANCE (MOTOR VEHICLE) ACT [Sections 34 and 45]. Order in Council 965/2001, approved and ordered November 7, 2001.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) effective on the date this order is deposited with the Registrar of Regulations, sections 1 to 6, 8 and 9 of the attached Appendix amend B.C. Reg. 447/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, in respect of a certificate, policy or endorsement

(

i) that is not a renewal, and

(ii) that takes effect on or after the date this order is deposited with the Registrar of Regulations,

(

b) effective January 1, 2002, sections 1 to 6, 8 and 9 of the attached Appendix amend B.C. Reg. 447/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, for all other purposes, and

(

c) effective January 1, 2002,

section 7 of the attached Appendix amends B.C. Reg. 447/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act . — G. COLLINS, Minister of Finance; G. CAMPBELL, Presiding Member of the Executive Council.

APPENDIX

Section 12 (3) of B.C. Reg. 447/83, the Revised Regulation (1984) under the Insurance (Motor Vehicle) Act, is repealed.

Section 113 is amended by adding the following definition:

"windshield damage" means any fractures, cracks or chips, caused by missiles or flying objects, occurring to the glass or other transparent shielding located at the front of a vehicle which protects or shields occupants of the vehicle from the wind.

Section 117 is amended by adding the following subsection:

(6) If an owner's certificate sets out a deductible amount of $300 for comprehensive coverage, the deductible amount applicable to any claim that includes windshield damage shall be $200.

Section 124 (1) is amended by striking out "a taxi or U-drive." and substituting "a taxi, a U-drive, a limousine use vehicle that is rated in vehicle rate class 695, or a limousine that is used for hire.".

Section 125 is amended

(

a) in subsection (1) by striking out "a taxi or U-drive." and substituting "a taxi, a U-drive, a limousine use vehicle that is rated in vehicle rate class 695, or a limousine that is used for hire", and

(

b) by repealing subsection (6).

Schedule 1 is amended by repealing Table 1 and substituting the following:

Section 9 of

Schedule 3 is amended by repealing subsection (2) and substituting the following:

(2) With respect to an accident occurring on or after January 1, 2002, for the purpose of

section 105 (2), the amount is limited to the amount by which the damage exceeds $750.

Schedule 5 is amended by repealing forms APV16 and APV36 and substituting the following:

Schedule 6 is amended by repealing forms APV281 and APV334 and substituting the following:

Pursuant to

section 6 of the Regulations Act, I hereby exempt from publication the amendments to Table 1 of

Schedule 1, as enacted by

section 6 of the B.C. Reg. 259/2001.

The exempted material may be inspected during office hours at the offices of the Insurance Corporation of British Columbia, 151 West Esplanade, North Vancouver, B.C.
