B.C. Reg. 365/2010 , deposited December 9, 2010, pursuant to the WORKERS COMPENSATION ACT [Sections 25 and 25.2]. Regulation of the Workers' Compensation Board, dated November 30, 2010.

CONSUMER PRICE INDEX ADJUSTMENTS

WHEREAS sections 25 and 25.2 of the Workers Compensation Act (" Act ") requires the Board to determine as of January 1, 2011, a percentage change by comparing the Consumer Price Index for October 2010 with the Consumer Price Index for October 2009 and by applying that percentage change to adjust those periodic payments of compensation referred to in

section 25 (3), and to adjust dollar amounts in the Act referred to in

section 25.2 (1);

AND

WHEREAS the Board is advised that the Consumer Price Index for October 2009 was 114.6 and for October 2010 was 117.4, giving a percentage change of 2.443281% and subtracting 1% gives a percentage change of 1.443281%;

AND

WHEREAS

section 25 (2) requires that the percentage resulting from calculations made under

section 25 (1), for purposes of

section 25 (3), must not be greater than 4% or less than 0%;

AND

WHEREAS B.C. Reg. 315/2009 amended dollar amounts described in

section 25.2 (1) as of January 1, 2010 as shown in column 1 below;

THE BOARD HEREBY DETERMINES THAT B.C. Reg. 315/2009 shall be repealed as of January 1, 2011;

AND THAT the percentage change applicable under

section 25 (1) (

b) is 1.443281%;

AND THAT the percentage change applicable under

section 25 (2) is 1.443281%;

AND THAT all periodic payments of compensation described in

section 25 (3) shall be adjusted by applying the percentage change of 1.443281% as of January 1, 2011;

AND THAT the percentage change applicable under

section 25.2 (1) is 2.443281%;

AND THAT all dollar amounts referred to in

section 25.2 (1) of the Act, shall be adjusted by applying the percentage change of 2.443281% as of January 1, 2011, as follows:
