OIC Text: The Governor in Council on the report and recommendation of the Minister of Energy dated August 13, 2008, and pursuant to

Section 6 of

Chapter 376 of the Revised Statutes of Nova Scotia, 1989, the Public Service Act, and

Section 59C of

Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to: 1. revoke Order in Council 2008-365 dated July 2, 2008; 2. approve a reviving and amending agreement between Her Majesty the Queen in Right of the Province of Nova Scotia as represented by the Minister of Energy and the panel appointed to consider Crown Share Adjustment Payments, being Lorne O. Clarke, Q.C.; Dara L. Gordon, Q.C.; and Dr. Brian Lee Crowley (the "Panel"), with respect to the payment or reimbursement of Panel operating costs in a form substantially as provided in

Schedule "A" to the Report and Recommendation; 3. approve a reviving and amending agreement between Canada and Nova Scotia with respect to the sharing of costs related to the Panel operations in the form substantially as provided in

Schedule "B" to the Report and Recommendation; 4. approve the entering into of the agreements referred to in paragraphs 2 and 3 under

Section 59C of the Provincial Finance Act; 5. authorize either of the Minister of Energy or the Deputy Minister of Energy to execute the agreements referenced in paragraphs 2 and 3.
