PROTECTED AREAS OF BRITISH COLUMBIA AMENDMENT ACT, 2016

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

SECTION 1: [Protected Areas of British Columbia Act,

Schedule C]

replaces the metes and bounds description of Garibaldi Park with an official plan description and changes the size of the park consequential to the official plan description;

changes the name of Halkett Bay Park, increases the size of the park and replaces the metes and bounds description of the park with an official plan description;

repeals the description of Okanagan Mountain Park, which is replaced with the description added by this Bill to

Schedule D;

increases the size of Prudhomme Lake Park and replaces the lot and parcel description of the park with an official plan description;

changes the name of sẁiẁs Park [a.k.a. Haynes Point Park];

repeals the description of Park [a.k.a. Okanagan Falls Park], which is replaced with the description added by this Bill to

Schedule D;

increases the size of Tweedsmuir Park.

Schedule C of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended

(

a) by repealing the descriptions of Garibaldi Park and Halkett Bay Park and substituting the following:

GARIBALDI PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in New Westminster District and Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1986.

The whole park containing approximately 188 661 hectares.

HALKETT BAY MARINE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 1, New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1914.

The whole park containing approximately 448 hectares (293 hectares of upland and 155 hectares of foreshore). ,

(

b) by repealing the description of Okanagan Mountain Park,

(

c) by repealing the description of Prudhomme Lake Park and substituting the following:

PRUDHOMME LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 5, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 2012.

The whole park containing approximately 9 hectares. ,

d) by repealing the name of sẃiẃs Park [a.k.a. Haynes Point Park] and substituting the following:

SẂIẂS PARK ,

(

e) by repealing the description of Park [a.k.a. Okanagan Falls Park], and

(

f) in the description of Tweedsmuir Park by striking out " The whole park containing approximately 989 616 hectares. " and substituting the following:

Fourthly: the most westerly 402.336 metres (20 chains) of District Lot 770, Range 3, Coast District; except that

part in Plan VIP54691.

The whole park containing approximately 989 714 hectares.

SECTION 2: [Protected Areas of British Columbia Act,

Schedule C] decreases the size of

Nahatlatch Park.

Schedule C is amended in the description of Nahatlatch Park

(

a) by striking out " Plan 14 Tube 1800; " and substituting " Plan 13 Tube 2011; ",

(

b) by striking out " and

(4) File FN02248 - Helicopter landing (Kookipi FSR). " and substituting "

(4) File FN02248 - Helicopter landing (Kookipi FSR); and (5) a 30 metre right of way centred on Forest Service Road 6996-15. ", and

(

c) by striking out " 2 009 hectares. " and substituting " 1 995 hectares. "

SECTION 3: [Protected Areas of British Columbia Act,

Schedule D]

changes the name of Mount Geoffery Escarpment Park;

establishes a new Class A park by adding a description of Ancient Forest/Chun T'oh Whudujut Park;

adds a description of Okanagan Mountain Park, which replaces the description repealed by this Bill from

Schedule C;

updates the size of Quesnel Lake Park;

adds a description of Park, which replaces the description repealed by this Bill from

Schedule C;

changes the name of Tazdli Wyiez Bin/Burnie-Shea Park.

Schedule D is amended

(

a) by repealing the name of Mount Geoffery Escarpment Park and substituting the following:

MOUNT GEOFFREY ESCARPMENT PARK ,

(

b) by adding the following descriptions:

ANCIENT FOREST/CHUN T'OH WHUDUJUT PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 2012.

The whole park containing approximately 11 190 hectares.

OKANAGAN MOUNTAIN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Similkameen Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 2012; except (1) the part of Lake Shore Road lying between Sections 17 and 18 of Township 28; and (2) the foreshore fronting Lots 2 to 6 of District Lot 2521 S , Plan 40167.

The whole park containing approximately 11 296 hectares. ,

c) in the description of Quesnel Lake Park by striking out " 872 hectares. " and substituting " 992 hectares. ",

(

d) by adding the following description:

PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Similkameen Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 2012.

The whole park containing approximately 2.6 hectares. , and

(

e) by repealing the name of Tazdli Wyiez Bin/Burnie-Shea Park and substituting the following:

BURNIE-SHEA PARK .

SECTION 4: [Protected Areas of British Columbia Act,

Schedule E] corrects the exception

statements and area figure for the conservancy and adds 28.5 hectares to the

conservancy.

Schedule E is amended in the description of Sheemahant Conservancy

(

a) by striking out " Plan 11 Tube 1969; except (1) a 30 metre right of way centred on Ministry of Forests and Range road FSR 7975; and (2) a 30 metre right of way centred on Ministry of Forests and Range Road Permit RO 0876, Forest Licence A16847. " and substituting " Plan 13 Tube 2012. ", and

(

b) by striking out " 1 018 hectares (815 hectares of upland and 203 hectares of foreshore). " and substituting " 1 015 hectares (812 hectares of upland and 203 hectares of foreshore). "

SECTION 5: [Rescission of order in council] rescinds the establishment by order in council

of Prudhomme Lake Park.

5 The establishment of Prudhomme Lake Park by Order in Council 1509/64 is rescinded.

6 The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:

Explanatory Notes

SECTION 1: [Protected Areas of British Columbia Act,

Schedule C]

replaces the metes and bounds description of Garibaldi Park with an official plan description and changes the size of the park consequential to the official plan description;
