Ecological reserves

The ecological reserves named and described in

Schedule A are continued or established for the purposes of the Ecological Reserve Act .

The ecological reserves established and described in orders in council referred to in

Schedule B are continued for the purposes of the Ecological Reserve Act .

Parks

The parks named and described in Schedules C and D are continued or established as Class A parks for the purposes of the Park Act .

Conservancies

2.1

The conservancies named and described in Schedules E and F are established or continued as conservancies for the purposes of the Park Act .

Boundaries described by official plans

For the purposes of this section, official plan means a plan that is

certified by the Surveyor General, by signature on the plan, to be an official plan, and

kept on deposit in the Crown land registry referred to in

section 7 of the Land Act .

All or part of the boundary of

an ecological reserve established under the Ecological Reserve Act or established or continued by this Act,

a.1

a conservancy established or continued by this Act, or

a park established or continued by this Act,

may be described by reference to

one or more official plans,

metes and bounds descriptions,

lot or parcel descriptions, or

any combination of the means referred to in paragraphs (

c) to (e).

To the extent of any variance between the marked representation of the boundary on an official plan and the metes and bounds or other written descriptions on the official plan, the metes and bounds or other written descriptions prevail.

Copies of official plans must be available for public inspection in the Crown land registry during regular business hours, and a person may obtain a copy of an official plan on payment of a fee prescribed under

section 6 (3) of the Land Act .

A copy of an official plan, that is certified by the Surveyor General to be a true copy, is admissible as evidence in a court without proof of the signature or official character of the Surveyor General.

If an official plan referred to in

Schedule C or D contains a reference to "by or under the Park Act ", that reference is deemed to be a reference to "under the Park Act or the Protected Areas of British Columbia Act ".

The whole ecological reserve containing approximately 295 hectares.

ANNE VALLEE (TRIANGLE ISLAND) ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 980 hectares (119 hectares of upland and 861 hectares of foreshore).

BAERIA ROCKS ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Barclay District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 1904.

The whole ecological reserve containing approximately 140 hectares (2 hectares of upland and 138 hectares of foreshore).

BALLINGALL ISLETS ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cowichan District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 29 Tube 1839.

CLAYHURST ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Peace River District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 1907; subject to any and all prior rights acquired under the provisions of the Water Act ; except a 100 metre right of way centred on Clayhurst Road, a

section 42 Transportation Act highway.

CLELAND ISLAND ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Clayoquot District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 11 Tube 1844.

COLUMBIA LAKE ECOLOGICAL RESERVE

EAST REDONDA ISLAND ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1913.

FORT NELSON RIVER ECOLOGICAL RESERVE

FRANCIS POINT ECOLOGICAL RESERVE

FRASER RIVER ECOLOGICAL RESERVE

GALIANO ISLAND ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Galiano Island, Cowichan District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1919.

GAMBLE CREEK ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 969 hectares.

GILNOCKIE CREEK ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 54 hectares.

GINGIETL CREEK ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cassiar District and contained within the following described boundaries:

Commencing at the northwest corner of that part of former "Zaulzap" Indian Reserve No. 29 lying to the north of Nass River;

thence on an approximate bearing of 39 00'00" a distance of approximately 2.066 kilometres to post number 81, which is to be set on the southeasterly boundary of the watershed of an unnamed creek that flows in a general southwesterly direction into Nass River, with post number 81 lying at bearing 0 00'00" a distance of approximately 403 metres from the most westerly northwest corner of former "Gitwinksihlkw" Indian Reserve No. 7;

thence northeasterly along the southeasterly boundary of the watershed of that unnamed creek to the southerly boundary of the watershed of Shumal Creek;

thence in a general westerly direction along the southerly boundary of the watershed of Shumal Creek to the easterly boundary of the watershed of Gingietl Creek;

thence northerly and westerly along the easterly and northerly boundaries of the watershed of Gingietl Creek and continuing westerly along the northerly boundary of the watershed of an unnamed creek that flows in a general southeasterly direction into Nass River to post number 82, which is to be set;

thence on a bearing of 158 38'00" a distance of 2.478 kilometres;

thence on a bearing of 154 51'00" a distance of approximately 1.080 kilometres to post number 83 which is to be set on the right bank natural boundary of Nass River;

thence northerly along that part of the westerly boundary of former "Zaulzap" Indian Reserve No. 29, lying to the north of Nass River, to the northwest corner of Nass River, with the northwest corner being the point of commencement.

The whole ecological reserve containing approximately 2 873 hectares.

GLADYS LAKE ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 40 541 hectares.

GOOSEGRASS CREEK ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 2 699 hectares.

GRAYLING RIVER HOT SPRINGS ECOLOGICAL RESERVE

The whole ecological reserve containing approximately 1 421 hectares.

HALEY LAKE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Dunsmuir District and Cowichan District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 1911.

The whole ecological reserve containing approximately 50 hectares (2 hectares of upland and 48 hectares of foreshore).

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 4, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1927.

KATHERINE TYE ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 2, New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2014.

The whole ecological reserve containing approximately 3.1 hectares.

KINGCOME RIVER/ATLATZI RIVER ECOLOGICAL RESERVE

MISTY LAKE ECOLOGICAL RESERVE

(1) Lot A, Plan PRP 13410, filed in the Prince Rupert Land Title Office; and (2) the 15 metre wide part of the bed and foreshore of Call Lake fronting the waterfront portion of Lot A, Plan PRP 13410, filed in the Prince Rupert Land Title Office.

The whole park containing approximately 60 hectares.

CALLAGHAN LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 1904; except (1) the right of way of the Caribou Highway No. 97 as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 435; (2) the new right of way for Highway No. 97 shown on Ministry of Transportation plans titled "For Right-of-Way Acquisition, Highway No. 97, Wright Station Curves, Drawing No. R2-640-103RW and Drawing No.

R2-640-104RW" on file with the Ministry of Transportation Kamloops Regional Office; and (3) the transmission line right of way as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 528.

The whole park containing approximately 955 hectares (259 hectares of upland and 696 hectares of foreshore).

(1) Plan 384 right of way, also shown on Plan 16 Tube 328 deposited in the Crown Land Registry;

(2) Plan 405 right of way;

(3) Plan 335 right of way, also shown on Plan 3RY202 and Plan 10RY207; and

(4) Ministry of Forests' Road No. 1059.

The whole park containing approximately 119 hectares (117 hectares of upland and 2 hectares of foreshore).

CHILLIWACK RIVER PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 2, New Westminster District and contained within the following described boundaries:

Firstly: that part of District Lot 439 described as commencing at the southeast corner of Lot 6 of District Lot 499, Plan 24589;

thence north along the east boundaries of Lot 6, "Road", Lot 1, all of District Lot 499, Plan 24589 and District Lot 792 to the south boundary of the road shown on Plan 53768;

thence in a general easterly direction along the south boundary of the road shown on Plan 53768 to the west boundary of Lot 3 of District Lot 780, Plan 37705;

thence South along the west boundaries of Lots 3 and 5 of District Lot 780, Plan 37705 to the southwest corner of Lot 5;

thence South along the southerly production of the west boundary of Lot 5 to the north boundary of District Lot 843;
