General information about corrections and minor changes
The Statutes and Regulations Act requires Manitoba legislation to be published on the Manitoba Laws website. Under subsection 25(1) of the Act, the chief legislative counsel is required to correct consolidation and publication errors.
Under subsection 25(2) of the Act, the chief legislative counsel may make minor corrections or changes to the consolidated version of
an Act or regulation without changing its legal effect.
Notice of the following types of minor changes must be given:
replacing a description of a date or time with the actual date or time; [s. 25(2)(f)]
replacing a reference to a bill or any part of a bill with a reference to the resulting Act or part of the Act after the bill is enacted and assigned a
chapter number; [s. 25(2)(g)]
removing a reference to a contingency in a provision that is stated to come into effect when or if that contingency occurs, if that contingency has occurred, or is required as a result of removing such a reference; [s. 25(2)(h)]
updating a reference to a person, office, organization, place or thing if
an Act provides that references to it are deemed or considered to be references to another person, office, organization, place or thing; [s. 25(2)(i)]
updating a reference to reflect a change in the name, title, location or address of a person, office, organization, place or thing, other than
a change in the name or title of a document adopted or incorporated by reference unless it was adopted or incorporated as amended from time to time, and
a change in the title of a minister or the name of a department; [s. 25(2)(j)]
updating a reference to a minister or department when, under subsection 5(3) of The Executive Government Organization Act , the Act is to be read as if it were amended as necessary to give effect to an order in council made under that Act; [s. 25(2)(k)]
correcting an error in the numbering of a provision or other portion of
an Act, or making a change to a cross-reference required as a result of such a correction; [s. 25(2)(l)]
correcting an obvious error in a cross-reference, if it is obvious what the correction should be; [s. 25(2)(m)]
if a provision of a transitional nature is contained in an amending Act, incorporating it as a provision of the consolidated Act and make any other changes that are required as a result; [s. 25(2)(n)]
removing a provision that is deemed by The
Interpretation Act to have been repealed because it has expired, lapsed or otherwise ceased to have effect. [s. 25(2)(o)]

Definitions
1 The following
definitions apply in column 3 of
Schedule A.
"angler" means a defendant who holds an angling licence or permit under The Fisheries Act or regulations under that Act. (« pêcheur à la ligne »)
"corp" means a defendant that is not an individual. (« corp. »)
"dealer" means a defendant who
(
a) holds a licence or permit as a dealer under the Act or regulation contravened; and
(
b) commits the offence while acting as a dealer. (« commerçant, marchand ou vendeur »)
"indiv" means a defendant who is an individual. (« part. »)
"non-angler" means a defendant who holds a licence or permit under The Fisheries Act or regulations under that Act that is not a licence or permit for angling. (« pers. ne pêchant pas à la ligne »)

Describing an offence in a ticket
2(1) The words, descriptions and abbreviations set out in column 2 of
Schedule A are prescribed for use on a ticket to specify an offence of contravening the provision of the Act or regulation set out in column 1.

(
b) bulleted words or phrases that appear on the same line may be used as alternatives to each other in the description of the alleged offence; and
(
c) bulleted uncapitalized phrases that appear on successive lines may be used as alternatives to each other in the description of the alleged offence if they are indented an equal amount and not separated by an unbulleted line of text.
2(3) Il est entendu que dans la colonne 2 de la version anglaise de l'annexe A :

Setting out fine in a ticket
3(1) When column 4 of
Schedule A contains a lettered fine category code from "A" to "J" for an offence described in column 2, the fine that may be set out in a ticket for the offence is the total fine set out for that fine category in the table in
Schedule B. The total fine consists of the preset fine, court costs, the surcharge amount under The Victims' Bill of Rights and the justice services surcharge set out for that fine category in that table.

3(2) When column 4 of
Schedule A does not contain a lettered fine category code but sets out directions for calculating the preset fine, court costs, the surcharge under The Victims' Bill of Rights and total fine, the fine that may be set out in a ticket for the offence
(
a) is the total fine calculated in accordance with the directions; and
(
b) consists of the preset fine, court costs and the surcharge under The Victims' Bill of Rights calculated in accordance with the directions, as well as the justice services surcharge.
3(2) Si la colonne 4 de l'annexe A ne comporte pas de code de catégorie d'amende mais contient des directives en vue du calcul de l'amende prédéterminée, des frais judiciaires, de l'amende supplémentaire que vise la Déclaration des droits des victimes ainsi que de l'amende totale, l'amende pouvant être inscrite sur le procès-verbal d'infraction :

3(3) For a parking offence described in column 2 of
Schedule A, the fine that may be set out in a ticket for the offence is the total fine set out in column 4 of
Schedule A, consisting of the preset fine and the court costs set out in that column.

3(4) Despite subsections (1) to (3), column 4 of
Schedule A may contain more than one fine category code for an offence when the fine category is different based on the type of defendant, the number of offences or the specifics of the offence.

Effect of amendment to Act or regulation
4 If a provision of
an Act or regulation set out in column 1 of
Schedule A is repealed in whole or in part and another provision is substituted, the reference to the provision in column 1 is deemed to be a reference to the substituted provision.
