An Act to Amend the Liquor Control Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Liquor Control Act,

chapter L-10 of the Revised Statutes, 1973, is amended by adding after

section 72 the following: 72.1(1) It is a condition of every licence of a class re- ferred to in paragraph 63(a), (b), (b.1), (c), (d), (e), (g), (h), (

i) and (

j) that the licensee comply with

section 7, subsec- tion 8(1) and

section 9 of the Smoke-free Places Act within the premises in respect of which his licence has been issued. 72.1(2) The condition stated in subsection (1) applies to a licence described in subsection (1) whether issued or re- newed before or after the commencement of this section. 2

Section 124.2 of the Act is amended (

a) in subsection (1) in the portion preceding para- graph (

a) by striking out “subsections (2)” and substi- tuting “subsections (1.1), (2)”; (

b) by adding after subsection (1) the following: PROJET DE LOI 36 Loi modifiant la

Loi sur les endroits sans fu- mée dans l’établissement visé par la licence. 72.1(2) La condition dont il est question au paragraphe (1) s’applique à une licence visée par ce paragraphe, que la licence ait été délivrée ou renouvelée avant ou après l’entrée en vigueur du présent article. 2 L’article 124.2 est modifié

a) au paragraphe (1), au passage qui précède l’ali- néa a), par la suppression de « des paragraphes (2) » et son remplacement par « des paragraphes (1.1), (2) »;

b) par l’adjonction après le paragraphe (1) de ce qui suit :

Loi sur la réglementation des alcools 124.2(1.1) The Adjudicator may cancel a licence of a class referred to in subsection 72.1(1) or suspend the li- cence for a period the Adjudicator considers proper where, after a hearing in accordance with

section 124.11, the Adjudicator is satisfied that the licensee has violated or failed to comply with subsection 72.1(1). 3 The Act is amended by adding after

section 124.41 the following: 124.42(1) Notwithstanding any other provision of this Act, the Minister may without a hearing and in accordance with the regulations, if any, cancel a licence of a class re- ferred to in subsection 72.1(1) or suspend the licence for a period of time the Minister considers appropriate if the licensee has been convicted of an offence under

section 7, subsection 8(1) or

section 9 of the Smoke-free Places Act that took place within the premises in respect of which the licence was issued. 124.42(2) A decision of the Minister under subsection (1) is final. 4 Subsection 200(1) of the Act is amended by adding after paragraph (q.13) the following: (q.14) respecting the cancellation or suspension of a licence under

section 124.42; 124.2(1.1) L’arbitre peut annuler une licence apparte- nant à une des catégories mentionnées au paragraphe 72.1(1) ou suspendre la licence pour la période qu’il juge appropriée dans le cas où, à la suite d’une audience tenue conformément à l’article 124.11, il est convaincu que son titulaire a contrevenu ou omis de se conformer au paragra- phe 72.1(1). 3 La Loi est modifiée par l’adjonction après l’article 124.41 de ce qui suit : 124.42(1) Nonobstant toute autre disposition de la pré- sente loi, le Ministre peut, sans la tenue d’une audience et conformément aux règlements, le cas échéant, annuler une licence appartenant à une des catégories mentionnées au paragraphe 72.1(1) ou suspendre la licence pour la pé- riode qu’il estime appropriée, si le titulaire de la licence a été déclaré coupable d’une infraction à l’article 7, au pa- ragraphe 8(1) ou à l’article 9 de la

Loi sur les endroits sans fumée qui a été commise dans l’établissement visé par la licence. 124.42(2) La décision du Ministre en vertu du paragra- phe (1) est finale. 4 Le paragraphe 200(1) de la Loi est modifié par l’ad- jonction après l’alinéa q.13) de ce qui suit : q.14) concernant l’annulation ou la suspension d’une licence en vertu de l’article 124.42;

An Act to Amend the Liquor Control Act Bill 36 EXPLANATORY NOTES

Section 1 A condition is added to certain licences issued under the Act in re- spect of compliance by the licensee with certain provisions under the Smoke-free Places Act.

Section 2 This

section provides the options for an adjudicator when a licensee is found to have breached the condition added to his licence under sec- tion 1 of this amending Act.

Section 3 This

section permits the Minister of Public Safety to cancel or sus- pend a licence, without a hearing and in accordance with the regula- tions, if any, where a licensee has been convicted under a specified pro- vision of the Smoke-free Places Act that took place in premises in respect of which his licence was issued.

Section 4 The regulation-making authority is expanded. NOTES EXPLICATIVES

Article 1 Addition d’une condition portant sur le respect de certaines dispo- sitions de la

Loi sur les endroits sans fumée pour certaines licences dé- livrées en vertu de la Loi.

Article 2 L’article prévoit des avenues pour l’arbitre lorsqu’il s’avère que le titulaire d’une licence a contrevenu à la condition ajoutée à sa licence en vertu de l’article 1 de la présente loi modificative.

Article 3 Cet

article permet au ministre de la Sécurité publique d’annuler ou de suspendre une licence, sans audition et conformément aux règle- ments, le cas échéant, lorsque le titulaire de la licence a été déclaré cou- pable d’une infraction à l’une des dispositions visées de la

Loi sur les endroits sans fumée commise dans l’établissement visée par la licence.
