Statute: Public Highways Act, Surplus Crown Property Disposal Act

OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal dated March 28, 2014, and pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act and

Section 11 of

Chapter 452 of the Revised Statues of Nova Scotia, 1989, the Surplus Crown Property Disposal Act , is pleased to: (

a) extinguish the right of the public to use those portions of public highway containing an area of 7.502 acres, more or less, of unused sections of road located at or near Starrs Point, County of Kings, more particularly described in

Schedule “A” and shown as “PARCEL 2014-1, western portion of PARCEL 2014-2, PARCEL 2014-3W, PARCEL 2014-3, PARCEL 2014-3E, PARCEL 2014-6, PARCEL 2014-7, PARCEL 2014-5, and PARCEL 2014-4” on

Schedule “B” which schedules are attached to and form part of the Report and Recommendation; (

b) authorize the conveyance of surplus lands containing an area of 0.72 acres, more or less, more particularly described in

Schedule “C” and shown as PARCEL 2014-3 on

Schedule “B” which schedules are attached to and form part of the Report and Recommendation, to Ruffneck Resources Limited, a registered company having its registered office in Kentville, County of Kings, for the nominal consideration of $1.00; (

c) authorize the conveyance of surplus lands containing an area of 4.776 acres, more or less more particularly described in

Schedule “D” and shown as “the western portion of PARCEL 2014-2, PARCEL 2014-3W, PARCEL 2014-3E, PARCEL 2014-7 and PARCEL 2014-4” on

Schedule “B” which schedules are attached to and form part of the Report and Recommendation, to Christopher Lloyd Cox and Susan D. Cox, both of Starrs Point, County of Kings, as Joint Tenants and not Tenants in Common, for nominal consideration of $1.00; and (

d) authorize the Minister of Transportation and Infrastructure Renewal to make and execute Deeds of Conveyance in such form as the Minister determines to affect the conveyance of the lands herein above described.
