Section 1 of the Public Trustee Act,

chapter P- 26.5 of the Acts of New Brunswick, 2005, is amended by add- ing the following

definitions in alphabetical order: 1 L’article 1 de la

Loi sur le curateur public, chapi- tre P-26.5 des Lois du Nouveau-Brunswick de 2005, est modifié par l’adjonction des définitions qui suivent dans l’ordre alphabétique : “Board” means the Board of Directors of the Commis- sion appointed under

section 29 of the Legal Aid Act . (conseil) “Commission” means the New Brunswick Legal Aid Services Commission established under

section 26 of the Legal Aid Act. (Commission) “Executive Director” means the Executive Director of Legal Aid appointed under

section 39 of the Legal Aid Act. (directeur général) « Commission » La Commission des services d’aide juridique du Nouveau-Brunswick constituée en vertu de l’article 26 de la

(Executive Director) 2 Subsection 2(1.1) of the Act is amended by striking out “applies” and substituting “does not apply”. 2 Le paragraphe 2 (1.1) de la Loi est modifié par la suppression de « s’applique » et son remplacement par « ne s’applique pas ». 3 Subsection 3(3) of the Act is amended by striking out “the Minister” and substituting “the Commission”. 3 Le paragraphe 3(3) de la Loi est modifié par la sup- pression de « du ministre » et son remplacement par « de la Commission ». 4

Section 4 of the Act is amended 4 L’article 4 de la Loi est modifié 1

(

a) by repealing subsection (1.1);

b) in subsection (2) by striking out “an employee of the Civil Service, as defined in

section 1 of the Civil Service Act” and substituting “a person employed in the Public Service as defined in the Public Service Su- perannuation Act”.

section 4 the fol- lowing: 5 La Loi est modifiée par l’adjonction de ce qui suit après l’article 4 : Terms of employment Conditions d’emploi 4.1(1) The Executive Director may, on behalf of the Commission, employ such persons as the Executive Di- rector considers necessary for the provision of services of the office of the Public Trustee. 4.1(1)

Le directeur général peut, pour le compte de la Commission, employer les personnes qu’il estime néces- saires pour assurer la prestation des services du bureau du curateur public. 4.1(2) The remuneration and other conditions of em- ployment of the employees in the office of the Public Trustee shall be established by the by-laws of the Board. 4.1(2) La rémunération et les autres conditions d’emploi des employés du bureau du curateur public sont établies par les règlements administratifs du conseil. 4.1(3) The Public Service Superannuation Act applies to the employees in the office of the Public Trustee. 4.1(3) La

Loi sur la Fonction publique ne s’applique pas aux employés du bureau du curateur public. 4.1(5) Subject to the approval of the Board, employees of the office of the Public Trustee are eligible to participate in any employee benefit program established by the Board of Management. 4.1(5)

Sous réserve de l’approbation du conseil, les em- ployés du bureau du curateur public sont admissibles aux programmes d’avantages sociaux des employés établis par le Conseil de gestion. 6 Subsection 9(5) of the Act is amended by striking out “the Minister of Finance for the purposes of subsection 17(1) of the Financial Administration Act” and substi- tuting “the Commission”. 6 Le paragraphe 9(5) de la Loi est modifié par la sup- pression de « le ministre des Finances pour l’application du paragraphe 17 (1) de la

Section 20 of the Act is amended 7 L’article 20 de la Loi est modifié (

a) in subsection (1) by striking out “the Minister” and substituting “the Commission”;

b) by adding after subsection (1) the following:
