An Act to Amend the Human Tissue Gift Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 Subsection 7(1) of the Human Tissue Gift Act, chap- ter H-12.5 of the Acts of New Brunswick, 2004, is re- pealed and the following is substituted: 7(1) For the purposes of post-mortem removal of a hu- man body part or parts for implantation in a living human body, the fact of death must be determined in accordance with accepted medical practice by (

a) at least medical practitioners, when the fact of death is determined in accordance with neurological criteria, or (

b) one medical practitioner, when the fact of death is determined by other criteria. 2

chapitre H-12.5 des Lois du Nouveau- Brunswick de 2004, est abrogé et remplacé par ce qui suit : 7(1) Aux fins d’un prélèvement post-mortem d’une par- tie ou de parties du corps humain en vue de leur implanta- tion dans un corps humain vivant, le décès doit être cons- taté conformément aux pratiques médicales généralement reconnues selon ce qui suit :

a) par au moins deux médecins, dans le cas où le constat de décès est fondé sur la mort neurologique;

b) par un seul médecin, dans le cas où le constat de décès est fondé sur tout autre critère que la mort neuro- logique. 2 L’article de la Loi est abrogé. 3

Section The existing provision is as follows: 7(1) For the purposes of post-mortem removal of a human body part or parts for implantation in a living human body, the fact of death must be determined by at least two medical practitioners in accordance with accepted medical practice.
