EXPLANATORY NOTE

The purpose of this Bill is to amend

section 28.2 of the Provincial Court Act,

1991 to validate the 2006 Provincial Court Judges' Salary and Benefits

Tribunal Report as of May 26, 2006 which is the date upon which its first

report was submitted to the minister and to require its second report

respecting judicial indemnity to be filed no later than March 1, 2007. The next following report would be presented

to the minister not later than April 1, 2010 . This amendment would be retroactive to April

1, 2006.

Be it enacted by the Lieutenant-Governor and

House of Assembly in Legislative Session convened, as follows:

(1) Subsection 28.2(1.1) of the Provincial Court Act, 1991 is amended by

deleting the word, comma and numbers "April 1, 2006" and substituting

the words, commas and numbers "May 26, 2006 and a second report respecting

judicial indemnity no later than March 1, 2007".

(2) Section 28.2 of the Act is amended by adding

immediately after subsection (1.1) the following:

(1.2) Notwithstanding subsection (1.1), the next

report required under subsection (1) after March 1, 2007 shall be presented to

the minister not later than April 1, 2010.

2. This Act shall be considered to have come into

force on April

1, 2006 .
