Barrachois Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

R.S.N.S. 1989, c. 367

O.I.C. 83-317 (March 29, 1983), N.S. Reg. 39/83

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 9th day of March, A.D., 1983, pursuant to

Section 2 of

Chapter 244 of the

Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to

(

a) constitute all that area of land situate at Barrachois, in the County of Cape

Breton, owned by Her Majesty the Queen in right of the Province of Nova

Scotia, to be a Provincial Park, the said area of land being described in

Schedule “A” and shown outlined in red on the copy of Crown Land Records

Plan No. E-13-44 marked

Schedule “B”, both Schedules attached to and

forming part of the report and recommendation; and

(

b) declare that the park shall be known by the name of “Barrachois Provincial

Park”.

Schedule “A”

All those certain two lots, pieces or parcels of land, situate, lying and being at or near

Barrachois Harbour, County of Cape Breton, Province of Nova Scotia, shown as Parcel “A”

and Parcel “B” on Plan No. E-13-44 filed in the Crown Land Records Office, Department of

Lands and Forests, Halifax, Nova Scotia, said two parcels of land being more particularly

described as follows:

Parcel “A”

Beginning at Survey Marker (S.M.) C.B. 2589 situated on the southerly boundary of Provincial

Highway Route No. 223 and at a northwesterly angle of lands now or formerly of the Estate of

Martha MacLean, said S.M. C.B. 2589 being (by grid azimuths referenced to the Nova Scotia

3° Modified Transverse Mercator Projection, Central Meridian 61° 30' west longitude) 84° 15'

49", 804.20 feet from Nova Scotia Coordinate Monument No. 2356;

From thence in a westerly direction following the southerly boundary of the said Provincial

Highway Route No. 223, 700 feet more or less to the northeasterly angle of lands now or

formerly of Raymond MacKley;

Thence 102° 33' 17" along a northeasterly boundary of lands now or formerly of Raymond

MacKley 89.32 feet to S.M. C.B. 2521;

Thence 148° 11' 04" along an easterly boundary of lands now or formerly of Raymond

MacKley 1320.46 feet to S.M. C.B. 2522;

Thence continuing 148° 11' 04" along the said easterly boundary of lands now or formerly of

Raymond MacKley 4 feet more or less to the ordinary high water mark of Little Pond so-called;

Thence following the various courses of the ordinary high water mark of Little Pond so-called

in a generally northeasterly direction 1400 feet more or less, to S.M. C.B. 2523 being

19° 53' 53", 782.64 feet from previously described S.M. C.B. 2522, said S.M. C.B. 2523 also

being situated at the southwesterly angle of lands now or formerly of the aforementioned Estate

of Martha MacLean;

Thence 326° 41 20" following a westerly boundary of lands now or formerly of the Estate of

Martha MacLean 564.13 feet to S.M. C.B. 2524 situated on the southerly boundary of a former

public road said road now being Crown land;

Thence following the southerly boundary of the former public road in a northeasterly direction

680 feet more or less or until it meets the southerly boundary of aforementioned Provincial

Highway Route No. 223;

Thence following the southerly boundary of Provincial Highway Route No. 223 in a westerly

direction 520 feet more or less or until it meets the northerly boundary of the aforementioned

former public road;

Thence following the northerly boundary of the former public road in a southwesterly direction

180 feet more or less or until it meets a westerly boundary of the aforementioned lands now or

formerly of the Estate of Martha MacLean;

Thence 326° 41' 20" following the said westerly boundary of lands now or formerly of the

Estate of Martha MacLean 33 feet more or less to the place of beginning, containing 15 acres

more or less.

Parcel “B”

Beginning at Survey Marker (S.M.) C.B. 2416 situated on the northerly boundary of Provincial

Highway Route No. 223 and at the southeasterly angle of lands now or formerly claimed by

Ester Griffet, said S.M. C.B. 2416 being (by grid azimuths referenced to the Nova Scotia 3°

Modified Transverse Mercator Projection, Central Meridian 61° 30' west longitude) 70° 01' 15",

848.05 feet from S.M. C.B 2589, the previously described point of beginning for Parcel “A”;

From thence 345° 53' 37" following the easterly boundary of lands now or formerly claimed by

Ester Griffet and crossing the Canadian National Railway right-of-way 932.90 feet to S.M.

C.B. 2415 situated on the northerly boundary of the said railway right-of-way;

Thence continuing 345° 53' 37" following the easterly boundary of lands now or formerly

claimed by Ester Griffet 170.22 feet to S.M. 2414 situated on the ordinary high water mark of

St. Andrews Channel;

Thence following the various courses of the ordinary high water mark of St. Andrews Channel

in a generally northeasterly and southeasterly direction and continuing around “The Barrachois”

so-called to the extreme tip thereof, a total distance of 5250 feet more or less, the said tip of

“The Barrachois” so-called also being the northerly shoreline of a small gut forming the

entrance to Big Pond so-called;

Thence following the various courses of the ordinary high water mark of Big Pond so-called in

a generally northwesterly and southwesterly direction 3950 feet more or less until it meets the

northerly boundary of the aforementioned Canadian National Railway right-of-way;

Thence following the northerly boundary of the Canadian National Railway right-of-way in a

westerly direction 1400 feet more or less to S.M. C.B. 2418;

Thence 165° 53' 37" crossing the Canadian National Railway right-of-way and then following

the westerly boundary of lands now or formerly claimed by John A. MacDonald a total distance

of 954.90 feet to S.M. C.B. 2417 situated on the aforementioned northerly boundary of

Provincial Highway Route No. 223;

Thence 257° 38' 07" following the northerly boundary of the said Provincial Highway Route

No. 223, 100.01 feet to the place of beginning, containing 32 acres more or less.
