Section 40 of the Occupational Health and Safety Act,

chapter O-0.2 of the Acts of New Brunswick, 1983, is amended 1 L’article 40 de la

a) in paragraph (b.1) by striking out “controlled product” and substituting “hazardous product”;

Section 40.1 of the Act is repealed and the follow- ing is substituted: 2 L’article 40.1 de la Loi est abrogé et remplacé par ce qui suit : 40.1(1) An employer shall provide, in respect of a haz- ardous product that is or was present in a place of em- ployment, any information, including confidential busi- ness information, that is in the possession of the employer to a medical practitioner or registered nurse who requests information on the hazardous product for the purpose of making a medical diagnosis, or rendering medical treatment to a person, in an emergency. 40.1(1) Lorsqu’un médecin ou une infirmière immatri- culée lui demande des renseignements sur un produit dangereux afin de rendre un diagnostique médical ou de fournir un traitement médical à une personne en cas d’urgence, l’employeur lui fournit les renseignements qu’il a en sa possession au sujet de tout produit dange- reux qui est ou était présent dans un lieu de travail, y compris les renseignements commerciaux confidentiels. 40.1(2) No person to whom information is provided by an employer under subsection (1) shall disclose or com- municate the information, other than to another medical 40.1(2) Il est interdit à quiconque obtient des rensei- gnements d’un employeur en application du para- graphe (1) de les divulguer ou de les communiquer, sauf 1

d) by repealing paragraph (j.3) and substituting the following:

e) by adding after paragraph (j.3) the following:

e) par l’adjonction de ce qui suit après l’ali- néa j.3) : (j.3.1) exempting persons or classes of persons from the requirements of obtaining or providing a safety data sheet in respect of a hazardous product; j.3.1) soustrayant des personnes ou des catégories de personnes de l’obligation d’obtenir ou de fournir une fiche de données de sécurité relatives à un produit dangereux; (

f) by repealing paragraph (j.4) and substituting the following:
