MISCELLANEOUS STATUTES (MODERNIZATION) AMENDMENT ACT, 2023

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Administrative Tribunals Act

CLAUSES 1 TO 3: [Administrative Tribunals Act, sections 10.2, 10.3 and 10.6] remove gendered language.

Section 10.2 (7) of the Administrative Tribunals Act, S.B.C. 2004, c. 45, is amended by striking out " he or she " and substituting " the executive chair ".

Section 10.3 (7) is amended by striking out " he or she " and substituting " the tribunal chair ".

Section 10.6 (3) and (4) is amended by striking out " his or her " and substituting " the individual's ".

Adoption Act

CLAUSES 4 TO 6: [Adoption Act, sections 1, 62 and 70.1] remove gendered language.

Section 1 (1) of the Adoption Act, R.S.B.C. 1996, c. 5, is amended in paragraphs (d) (ii) and (

e) of the definition of "Indigenous child" by striking out " considers himself or herself to be " and substituting " considers themselves to be ".

Section 62 (3) is amended by striking out " his or her " and substituting " the director's ".

Section 70.1 is amended by striking out " exercise his or her powers or perform his or her duties " and substituting " exercise powers or perform duties ".

Animal Health Act

CLAUSES 7 TO 11: [Animal Health Act, various sections] remove gendered language.

Section 10 (3) of the Animal Health Act, S.B.C. 2014, c. 16, is amended by striking out " his or her " and substituting " the operator's ".

Section 13 (

a) is amended by striking out " himself or herself " and substituting " themselves ".

Section 15 (5) is amended by striking out " his or her " and substituting " a ".

Section 20 (1) (

b) is amended by striking out " his or her " and substituting " the inspector's, the veterinarian's or the person's ".

Architects (Landscape) Act

CLAUSE 12: [Architects (Landscape) Act,

section 6] removes gendered language.

Section 6 (1) and (2) of the Architects (Landscape) Act, R.S.B.C. 1996, c. 18, is amended by striking out " he or she " and substituting " the person ".

Armoured Vehicle and After-Market Compartment Control Act

CLAUSES 13 AND 14: [Armoured Vehicle and After-Market Compartment Control Act, sections 4 and 6] remove gendered language.

Section 4 (1) of the Armoured Vehicle and After-Market Compartment Control Act, S.B.C. 2010, c. 8, is amended

(

a) in paragraph (

b) by striking out " he or she " and substituting " the applicant or permit holder ", and

B.C. Rail Benefits (First Nations) Trust Act

CLAUSES 21 AND 22: [B.C. Rail Benefits (First Nations) Trust Act, sections 4 and 6] remove gendered language.

Section 4 of the B.C. Rail Benefits (First Nations) Trust Act, S.B.C. 2004, c. 58, is amended

(

a) by repealing subsection (1) and substituting the following:

(1) The directors of the B.C. Rail Benefits (First Nations) Trust are,

(

a) for each first nation that is a Beneficiary First Nation, the chief of the first nation or the chief's designate, or, if the first nation does not have a chief, the individual acting in that capacity for the first nation or the individual's designate, and

(

b) for each treaty society that is a Beneficiary First Nation, the executive director of the treaty society or the executive director's designate, or, if the treaty society does not have an executive director, the individual acting in that capacity for the treaty society or the individual's designate. , and

(

b) in subsection (2) by striking out " he or she " and substituting " the director ".

Section 6 is amended by striking out " his or her " and substituting " the director's ".

Body Armour Control Act

CLAUSES 23 AND 24: [Body Armour Control Act, sections 5 and 7] remove gendered language.

Section 5 (1) of the Body Armour Control Act, S.B.C. 2009, c. 24, is amended

(

a) in paragraph (

b) by striking out " he or she " and substituting " the applicant or permit holder ", and

(

b) in paragraph (

c) by striking out " his or her " and substituting " the ".

Section 7 (a), (

b) and (

c) is amended by striking out " his or her " wherever it appears and substituting " the permit holder's ".

British Columbia Railway Act

CLAUSE 25: [British Columbia Railway Act,

section 32] removes gendered language.

Section 32 (1) of the British Columbia Railway Act, R.S.B.C. 1996, c. 36, is amended by striking out " his or her " and substituting " the director's ".

CLAUSE 26: [British Columbia Railway Act,

section 52] repeals an obsolete provision.

Section 52 (11) is repealed.

British Columbia Transit Act

CLAUSES 27 AND 28: [British Columbia Transit Act, sections 4 and 25] remove gendered language.

Section 4 (3) of the British Columbia Transit Act, R.S.B.C. 1996, c. 38, is amended by striking out " his or her " and substituting " the chief executive officer's ".

Section 25 is amended

(

a) in subsection (9) by striking out " his or her " and substituting " the person's ", and

(

b) in subsection (10) by striking out " his or her " and substituting " the member's ".

CLAUSE 29: [British Columbia Transit Act,

section 28] explicitly allows for resolutions of the board of British Columbia Transit passed under

section 28 of the Act to be approved by electronic mail.

Section 28 (3) is amended by adding " electronic mail, " after " telegraph, ".

Budget Transparency and Accountability Act

CLAUSES 30 AND 31: [Budget Transparency and Accountability Act, sections 4 and 4.1] remove gendered language.

Section 4 (5) of the Budget Transparency and Accountability Act, S.B.C. 2000, c. 23, is repealed and the following substituted:

(5) A person who is a member and who is identified in the appointment order by reference to the person's position in an organization ceases to be a member if the person ceases to hold that position in that organization.

Section 4.1 (6) is repealed and the following substituted:

(6) A person who is a member and whose appointment to the committee depends on the person holding a specified position in an organization ceases to be a member if the person ceases to hold that position in that organization.

Building Act

CLAUSE 32: [Building Act,

section 29] removes gendered language.

Section 29 (5) of the Building Act, S.B.C. 2015, c. 2, is amended by striking out " his or her " and substituting " the registrar's ".

Business Corporations Act

CLAUSES 33 TO 41: [Business Corporations Act, various sections] remove gendered language.

Section 107 (3) of the Business Corporations Act, S.B.C. 2002, c. 57, is amended by striking out " his or her " and substituting " the shareholder's ".

Section 126 (

c) is amended by striking out " he or she " and substituting " each former director ".

35 Sections 128 (1) (a) (ii) and 157 (1) are amended by striking out " his or her " and substituting " the director's ".

Section 140 (3) (a) (

i) is amended by striking out " he or she " and substituting " the director ".

Section 151 (

Section 192 (1) is amended in paragraph (

Business Practices and Consumer Protection Act

CLAUSES 42 TO 44: [Business Practices and Consumer Protection Act, various sections] remove gendered language.

Section 8 (3) (

b) of the Business Practices and Consumer Protection Act, S.B.C. 2004, c. 2, is amended by striking out " his or her own interest because of the consumer or guarantor's physical or mental infirmity " and substituting " the consumer or guarantor's own interest because of physical or mental infirmity ".

43 Sections 12 (1) and 14 (1) are amended by striking out " his or her " and substituting " the consumer's ".

Section 25 (4) (

c) is amended by striking out " his or her " and substituting " the supplier's ".

Business Practices and Consumer Protection Authority Act

CLAUSE 45: [Business Practices and Consumer Protection Authority Act,

section 18] removes gendered language.

Section 18 (

b) of the Business Practices and Consumer Protection Authority Act, S.B.C. 2004, c. 3, is amended by striking out " an interest he or she has " and substituting " the director's or officer's own interest ".

Chartered Professional Accountants Act

CLAUSES 46 TO 49: [Chartered Professional Accountants Act, various sections] remove gendered language.

Section 40 (3) (

c) of the Chartered Professional Accountants Act, S.B.C. 2015, c. 1, is amended by striking out " her or his " wherever it appears and substituting " the shareholder's ".

Section 42 (3) (

c) is amended by striking out " her or his " wherever it appears and substituting " the shareholder's, partner's or proprietor's ".

Section 43 (1) is amended by striking out " her or his " and substituting " the member's ".

Section 47 (3) (

c) is amended by striking out " her or his " wherever it appears and substituting " the employee's ".

Child, Family and Community Service Act

CLAUSES 50 TO 56: [Child, Family and Community Service Act, various sections] remove gendered language.

Section 1 (1) of the Child, Family and Community Service Act, R.S.B.C. 1996, c. 46, is amended in paragraphs (d) (ii) and (

e) of the definition of "Indigenous child" by striking out " considers himself or herself to be " and substituting " considers themselves to be ".

Section 15 (1) is amended by striking out " him or her " and substituting " the child ".

Coastal Ferry Act

CLAUSES 57 AND 58: [Coastal Ferry Act, sections 1 and 8] remove gendered language.

Section 1 of the Coastal Ferry Act, S.B.C. 2003, c. 14, is amended in the definition of "executive" by striking out " his or her " and substituting " the individual's ".

Section 8 (2) is amended by striking out " he or she " wherever it appears and substituting " the director ".

CLAUSE 59: [Coastal Ferry Act,

section 13] explicitly allows for resolutions of the directors of the B.C. Ferry Authority to be approved by electronic mail.

Section 13 (5) is amended by striking out " by telex, telegraph, facsimile or other electronic transmission " and substituting " by telex, telegraph, facsimile, electronic mail or other electronic transmission ".

CLAUSES 60 AND 61: [Coastal Ferry Act, sections 37 and 70] remove gendered language.

Section 37 is amended

(

a) by repealing subsection (2) and substituting the following:

(2) The commissioner and any deputy commissioner in whom a beneficial interest referred to in subsection (1) is or becomes vested must divest the beneficial interest within 3 months after the later of

(

a) the appointment or hiring, as the case may be, of the commissioner or deputy commissioner, and

(

b) the acquisition of the beneficial interest by the commissioner or deputy commissioner. , and

(

b) in subsection (4) by striking out " divest himself or herself of that interest " and substituting " divest that interest ".

Section 70 (2) is amended by striking out " his or her " and substituting " their ".

College and Institute Act

CLAUSE 62: [College and Institute Act,

section 40] removes gendered language.

Section 40 of the College and Institute Act, R.S.B.C. 1996, c. 52, is amended

(

a) in subsection (1) by striking out " he or she " and substituting " the president ", and

(

b) in subsections (2) and (4) by striking out " his or her " wherever it appears and substituting " the employee's ".

Commercial Tenancy Act

CLAUSES 63 TO 71: [Commercial Tenancy Act, various sections] remove gendered language.

Section 1 of the Commercial Tenancy Act, R.S.B.C. 1996, c. 57, is amended by striking out " his or her " and substituting " the party's " and by striking out " he or she " and substituting " the party ".

Leases: renewal for benefit of infant

(iii) in all other cases, to the head office of the corporation, or

c) by sending it by electronic mail to the last known electronic mail address
