B.C. Reg. 189/2002, deposited July 5, 2002, pursuant to the WILDLIFE ACT [section 108 (2)]. Order in Council 577/2002, approved and ordered July 4, 2002.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Closed Areas Regulation, B.C. Reg. 76/84, is amended as set out in the attached Appendix. — J. MURRAY,
Minister of Water, Land and Air Protection ; G. CAMPBELL, Presiding Member of the Executive Council.
APPENDIX
1 The Closed Areas Regulation, B.C. Reg. 76/84, is amended in
Schedule 5:
(
a) in item 32 by striking out "except that part of M.U. 1-1 that is" and substituting "except those parts of M.U.s 1-1 and 1-2 that are", and
(
b) by adding the following section:
Buckley Bay
133 That portion of the Province of British Columbia in M.U. 1-06 in the vicinity of Buckley Bay, Nelson Land District, within the following described boundaries:
Commencing at the northwest corner of
section 2, Lot 1 (Base Flat) on the mean high water mark of Lot 1; thence due north to a point 100 metres offshore; thence in an easterly and southerly direction maintaining a distance of 100 metres from the mean high water mark of Lot 1 to a point 100 m offshore from the southeast corner of Lot 1 which is also the northeast corner of Lot 44; thence in a southerly and westerly direction maintaining a distance of 100 metres offshore from the mean high water mark of Lot 44 to a point on the east shore of Vancouver Island; thence due west to the east side of Highway 19A; thence northerly along the east side of Highway 19A to its intersection with the west boundary of
section 2, Lot 1; thence northerly to the point of commencement.
Schedule 7 is amended by repealing item 29.
Schedule 9 is amended
(
a) in item 17 by striking out "Highway 25" and substituting "Highway 37A" and by inserting "along the east bank of Clearwater Creek" after "Clearwater Creek; thence in a northerly direction" and by inserting "along the mean high water mark of Lakelse Lake" after "northerly, easterly and southerly direction", and
(
b) by adding the following item:
Stamp Lagoon
26 That portion of the Province of British Columbia in M.U. 1-07 in the vicinity of Port Alberni within the following described boundaries:
Commencing at the confluence of Turtle Creek and Stamp River; thence due north to a point 100 metres north of the Stamp River; thence westerly at a distance of 100 metres from the northerly shoreline of the Stamp River to a point 100 metres due north of where the Stamp River enters Stamp Lagoon on the east side of the lagoon; thence westerly at a distance of 100 m from the northerly shoreline of Stamp Lagoon to a point 100 metres north of where the Stamp River enters Stamp Lagoon on the west side of the lagoon; thence southerly to a point 100 metres due south of the Stamp River; thence easterly at a distance of 100 metres from the southerly shoreline of Stamp Lagoon to a point 100 metres due south of where the Stamp River enters Stamp Lagoon on the east side of the lagoon; thence easterly at a distance of 100 metres from the southerly shoreline of the Stamp River to a point due south of the confluence of Turtle Creek and Stamp River; thence northerly to the point of commencement.
Schedule 14 is amended by repealing item 1 (1) and substituting the following:
(1) Commencing at the mean high water mark of the eastern coast of Vancouver Island at the southern boundary of the District of Campbell River and proceeding west along said boundary to the western boundary of Highway 19; thence southerly along the western boundary of said highway to its intersection with the junction of Highways 4 and 4A and the British Columbia Hydro and Power Authority transmission line right of way 763 in the vicinity of Parksville; thence southerly along said transmission line to the north side of Dumont Road; thence along the north side of Dumont Road to its intersection with the boundary of the City of Nanaimo; thence northerly along said boundary to the mean high water mark of the eastern coast of Vancouver Island; thence northerly along said high water mark to the southern boundary of the District of Campbell River and including the land area above the mean low water mark of Denman and Hornby Islands.
