OIC Text: 2009-465 The Governor in Council on the report and recommendation of the Minister of Transportation and Infrastructure Renewal dated October 1, 2009, and pursuant to Sections 5, 6 and 8 of
Chapter 1 of the Acts of 1997 (2nd Session), the Highway Workers Collective Bargaining Act, is pleased to: (
a) appoint Susan Ashley of Wolfville, Kings County, as a member and designate her as Chair of the Highway Workers Employee Relations Board for a term of one year commencing November 3, 2009 and to determine her remuneration at the rate of $10,000.00 per annum, and, in addition, $150.00 per day while sitting as a Board member at a hearing, plus actual and reasonable expenses as may be incurred by her in the discharge of her duties; (
b) appoint Malcolm Boyle of Halifax, Halifax Regional Municipality, as a member of the Highway Workers Employee Relations Board for a term of one year commencing November 3, 2009, and to determine his remuneration at the rate of $2,000.00 per annum, and, in addition, $150.00 per day while sitting as a Board member at a hearing, plus actual and reasonable expenses as may be incurred by him in the discharge of his duties; (
c) appoint Burnley A. Jones of Halifax, Halifax Regional Municipality, as a member of the Highway Workers Employee Relations Board for a term of one year commencing November 3, 2009 and to determine his remuneration at the rate of $2,000.00 per annum, and, in addition, $150.00 per day while sitting as a Board member at a hearing, plus actual and reasonable expenses as may be incurred by him in the discharge of his duties; and (
d) order that the Province shall defend, negotiate or settle claims or charges made against Susan Ashley, Malcolm Boyle and Burnley A. Jones, and indemnify them from personal liability, provided that the Province is satisfied that the claim arises out of their activities in relation to their appointments and is not based on fraud or criminal activity and where the Province so defends, the Province will be in control of the case.
