OIC Text: The Governor in Council on the report and recommendation of the Minister of Environment and Labour dated June 4, 2003, pursuant to Sections 5 and 7 of

Chapter 11 of the Acts of 1992, the Utility and Review Board Act, is pleased to: (

a) effective August 31, 2002, accept the resignation and revoke the appointment and designation of Linda D. Garber of Halifax, Halifax Regional Municipality, as a full-time member of the Nova Scotia Utility and Review Board, which appointment was made by Order in Council 96-464 dated June 25, 1996; (

b) effective immediately, appoint Peter Gurnham of Halifax, Halifax Regional Municipality, as a full-time member of the Nova Scotia Utility and Review Board; (

c) determine the remuneration of Peter Gurnham, as a full-time member of the Nova Scotia Utility and Review Board, to be in accordance with the management compensation pay plan (MCP 38)(0.90), approved from time to time by the Governor in Council, in accordance with Order in Council 99-396, dated August 9, 1999; (

d) order that the Province shall defend, negotiate or settle claims or charges made against Peter Gurnham as a full-time member of the Nova Scotia Utility and Review Board and indemnify him from personal liability, provided however, that any claim arising out of his activity in relation to his appointment and designation is not based on fraud or criminal activity, and where the Province so defends him, the Province will be in control of the case.
