An Act respecting the

City of Brampton

Preamble

The Corporation of the City of Brampton, referred to in this Act as the Corporation, has applied for special legislation to require abutting property owners to maintain the boulevard portion of any highway.

It is appropriate to grant the application.

Therefore, Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

By-laws respecting boulevards

1. The council of the Corporation may pass by-laws,

(

a) requiring the owners or occupants of any designated class of building in the municipality or any designated area in it to maintain the boulevard portion of any highway or part of a highway or any class of highways, including any paved

portion which may form part of a driveway apron in front of, alongside or at the rear of any building or vacant lot;

(

b) providing for the maintenance of the boulevard portion described in clause (a), at the expense of the owners, and for collecting or recovering the expenses incurred in so doing in any manner including in like manner as municipal taxes.

Enforcement

(1) No step shall be taken to enforce a by-law under

section 1 until the owner or occupant of the land has been given a written notice requiring compliance with the by-law.

Notice

(2) The notice may be given personally or by registered mail to the last known address of the person to whom it is sent.

Placard

(3) If the Corporation is unable to effect service personally or by registered mail, notice may be given by placing a placard containing the terms of the notice in a conspicuous place on the land, and the placing of the placard shall be deemed

to be sufficient service of the notice on the owner or occupant.

Commencement

3. This Act comes into force on the day it receives Royal Assent.

4. The

short title of this Act is the City of Brampton Act, 1996 .
