An Act to enhance privacy enforcement and accountability by amending the Freedom of Information and Protection of Privacy Act and the Municipal Freedom of Information and Protection of Privacy Act with respect to the Commissioner’s powers Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows: AMENDMENTS TO FREEDOM OF INFORMATION AND PROTECTION OF PRIV ACY ACT 1. Subsection 50 (4) of the Freedom of Information and Protection of Privacy Act is repealed and the following substituted:

(4) The Ombudsman Act does not apply, (

a) in respect of a complaint, (

i) for which an appeal is provided under this Act or the Municipal Freedom of Information and Protection of Privacy Act , (ii) that the Commissioner deals with by means of a compliance inves- tigation or compliance audit under

section 51.1; or (

b) to the Commissioner or the Commis- sioner’s delegate acting under this Act or the Municipal Freedom of Informa- tion and Protection of Privacy Act .

Section 51 of the Act is repealed and the following substituted: 51.

(1) The Commissioner may authorize a mediator to investigate the circumstances of any appeal and to try to effect a settlement of the matter under appeal.

(1) Le commissaire peut autoriser un médiateur à enquêter sur les circonstances qui entourent l’appel et à tenter de parvenir au règlement de la question qui en fait l’objet.

(1) The Commissioner has power to conduct compliance investigations and com- pliance audits with respect to issues of com- pliance with this Act.

(2) Before commencing a compliance investigation or a compliance audit, the Com- missioner shall give the head of the institution concerned notice of, (

a) the intention to conduct the investiga- tion or audit; and (

b) the subject matter of the investigation or audit. 4. (1) Subsection 52 (1) of the Act, as re- enacted by the Statutes of Ontario, 1996,

chapter 1,

section 9, is repealed and the following substituted:

(1) When there is an appeal under this Act, the Commissioner may conduct an inquiry to review the head’s decision if, (

a) no mediator has been authorized to act under subsection 51 (1); or (

b) a mediator has been authorized to act under subsection 51 (1) but no settle- ment has been effected.

(1.1) The Commissioner may conduct a compliance investigation by way of an inquiry, (

a) on receiving a complaint from an indi- vidual about an issue of compliance with this Act, if, (

i) no mediator has been authorized to act under subsection 51 (2), or (ii) a mediator has been authorized to act under subsection 51 (2) but no settlement has been effected; (

b) on the request of the head of an institu- tion concerning an issue of compliance with this Act that affects the institution; or (

c) on his or her own initiative, if it appears to the Commissioner that an institution may not be complying with this Act. (2) Subsection 52 (2) of the Act is amended by striking out “under subsection (1)” and substituting “under subsection (1) or (1.1)”. entourent la plainte et à tenter de parvenir à son règlement. 3. chapitre 1 des Lois de l’Ontario de 1996, est abrogé et remplacé par ce qui suit :

(1.1) Le commissaire peut mener une en- quête de conformité dans l’un ou l’autre des cas suivants :

a) lorsqu’il reçoit une plainte d’un particu- lier sur une question de conformité à la présente loi et que, selon le cas : (

i) aucun médiateur n’a été autorisé à agir aux termes du paragraphe 51 (2), (ii) un médiateur a été autorisé à agir aux termes du paragraphe 51 (2), mais aucun règlement n’est inter- venu;

b) à la demande de la personne responsa- ble d’une institution portant sur une question de conformité à la présente loi qui concerne l’institution;

c) de sa propre initiative, s’il lui semble qu’une institution ne se conforme peut- être pas à la présente loi.

Section 54 of the Act, as amended by the Statutes of Ontario, 1996,

chapter 1,

section 10, is repealed and the following substituted: 54.

(1) After all the evidence for an inquiry under subsection 52 (1) or (1.1) has been re- ceived, the Commissioner shall make an order disposing of all the issues raised.

(2) In the case of an inquiry under subsec- tion 52 (1), if the Commissioner upholds a decision of a head that the head may refuse to disclose a record or a part of a record, the Commissioner shall not order the head to dis- close the record or part.

(3) In the case of an inquiry under subsec- tion 52 (1.1), the Commissioner may make an order requiring, (

a) that a duty imposed by this Act be per- formed; (

b) that an institution cease collecting, using or disclosing personal informa- tion in contravention of this Act; (

c) that an institution destroy personal information collected, used or disclosed in contravention of this Act; (

d) that an institution change, cease follow- ing or refrain from commencing a specified information practice that contravenes this Act; (

e) that an institution implement a speci- fied information practice that complies with this Act; (

f) that an institution, within a specified time, give the Commissioner,

chapitre 1 des Lois de l’Ontario de 1996, est abrogé et remplacé par ce qui suit : 54.

(1) Lorsque toutes les preuves ont été reçues dans le cadre d’une enquête menée en vertu du paragraphe 52 (1) ou (1.1), le com- missaire rend une ordonnance qui tranche tou- tes les questions soulevées.

(2) Dans le cas d’une enquête menée en vertu du paragraphe 52 (1), si le commissaire confirme la décision de la personne responsa- ble de refuser la divulgation d’un document en totalité ou en partie, il ne doit pas enjoindre à celle-ci de divulguer le document ou la

partie visée.

(3) Dans le cas d’une enquête menée en vertu du paragraphe 52 (1.1), le commissaire peut, par ordonnance, exiger, selon le cas :

a) qu’une obligation qu’impose la présente loi soit exécutée;

b) qu’une institution cesse de recueillir, d’utiliser ou de divulguer des rensei- gnements personnels contrairement à la présente loi;

c) qu’une institution détruise les rensei- gnements personnels recueillis, utilisés ou divulgués contrairement à la présen- te loi;

d) qu’une institution modifie, cesse de sui- vre ou s’abstienne d’adopter une prati- que précisée en matière de renseigne- ments qui contrevient à la présente loi;

e) qu’une institution mette en oeuvre une pratique précisée en matière de rensei- gnements qui se conforme à la présente loi;

f) qu’une institution donne au commis- saire, dans le délai précisé : Ordonnance à la suite d’une enquête Idem Idem Projet 93Sec./art. 4

i) notice of any action taken or pro- posed to implement the Commis- sioner’s recommendations, or (ii) reasons why no such action has been taken or proposed.

(4) Subject to this Act, an order under this

section may contain any terms and conditions the Commissioner considers appropriate.

(5) The Commissioner shall give written notice of the order, (

a) in the case of an order made under sub- section (1), to the appellant and the per- sons who received notice of the appeal under subsection 50 (3); (

b) in the case of an order made under sub- section (3), to the individual who made the complaint, the head of the institu- tion concerned and any other affected person.

(6) A copy of an order made under this section, without the reasons, may be filed with the Superior Court of Justice, in which case it shall be entered in the same way as an order of that court and is enforceable as such. 54.1

(1) The Commissioner has discretion to carry out compliance audits in respect of personal information and other records under the control of institutions, to ensure com- pliance with this Act.

(2) Subsection 51.1 (2) and

section 52 apply to compliance audits, with necessary modifications.

(3) If the Commissioner, on completing a compliance audit, considers that an institution has not complied with this Act, the Commis- sioner shall provide the head of the institution with a report containing his or her findings and any recommendations that he or she con- siders appropriate.

(4) In the report, the Commissioner may require the institution to give him or her, within a specified time, (

a) notice of any action taken or proposed to implement the Commissioner’s rec- ommendations; or (

b) reasons why no such action has been taken or proposed. (

a) dans le cas d’une ordonnance rendue en vertu du paragraphe (1), à l’appelant et aux personnes qui ont reçu l’avis d’ap- pel aux termes du paragraphe 50 (3);

b) dans le cas d’une ordonnance rendue en vertu du paragraphe (3), au particulier qui a présenté la plainte, à la personne responsable de l’institution visée et à toute autre personne intéressée.

(6) Une copie de l’ordonnance rendue en vertu du présent

article peut être déposée, sans les motifs, auprès de la Cour supérieure de justice, auquel cas elle est consignée de la même façon qu’une ordonnance de ce tribunal et est exécutoire au même titre. 54.1

(1) Le commissaire peut, à sa discré- tion, effectuer des vérifications de conformité à l’égard des renseignements personnels et des autres documents dont les institutions ont le contrôle, afin de veiller au respect de la pré- sente loi.

(2) Le paragraphe 51.1 (2) et l’article 52 s’appliquent, avec les adaptations nécessaires, aux vérifications de conformité.

(3) S’il estime, à l’issue d’une vérification de conformité, qu’une institution ne s’est pas conformée à la présente loi, le commissaire présente à la personne responsable de l’institu- tion un rapport qui comporte ses conclusions et toutes recommandations qu’il estime appro- priées.

(4) Dans son rapport, le commissaire peut exiger de l’institution qu’elle lui donne, dans le délai précisé :

a) soit un avis des mesures prises ou pro- posées afin de mettre en oeuvre les re- commandations du commissaire;

b) soit les motifs pour lesquels de telles mesures n’ont pas été prises ni propo- sées. Conditions

section may contain any terms and conditions the Commissioner considers appropriate.

(5) The Commissioner shall give written notice of the order, (

a) in the case of an order made under sub- section (1), to the appellant and the per- sons who received notice of the appeal under subsection 39 (3); (

b) in the case of an order made under sub- section (3), to the individual who made the complaint, the head of the institu- tion concerned and any other affected person.

(6) A copy of an order made under this section, without the reasons, may be filed with the Superior Court of Justice, in which case it shall be entered in the same way as an order of that court and is enforceable as such. 43.1

(1) The Commissioner has discretion to carry out compliance audits in respect of personal information and other records under the control of institutions, to ensure com- pliance with this Act.

(2) Subsection 40.1 (2) and

section 43 apply to compliance audits, with necessary modifications.

(3) If the Commissioner, on completing a compliance audit, considers that an institution has not complied with this Act, the Commis- sioner shall provide the head of the institution with a report containing his or her findings and any recommendations that he or she con- siders appropriate. ou divulgués contrairement à la présen- te loi;

(4) Sous réserve de la présente loi, l’ordon- nance rendue en vertu du présent

article peut être assortie des conditions que le commis- saire estime appropriées.

(5) Le commissaire donne un avis écrit de l’ordonnance aux personnes suivantes :

a) dans le cas d’une ordonnance rendue en vertu du paragraphe (1), à l’appelant et aux personnes qui ont reçu l’avis d’ap- pel aux termes du paragraphe 39 (3);

b) dans le cas d’une ordonnance rendue en vertu du paragraphe (3), au particulier qui a présenté la plainte, à la personne responsable de l’institution visée et à toute autre personne intéressée.

(6) Une copie de l’ordonnance rendue en vertu du présent

article peut être déposée, sans les motifs, auprès de la Cour supérieure de justice, auquel cas elle est consignée de la même façon qu’une ordonnance de ce tribunal et est exécutoire au même titre. 43.1

(1) Le commissaire peut, à sa discré- tion, effectuer des vérifications de conformité à l’égard des renseignements personnels et des autres documents dont les institutions ont le contrôle, afin de veiller au respect de la pré- sente loi.

(2) Le paragraphe 40.1 (2) et l’article 43 s’appliquent, avec les adaptations nécessaires, aux vérifications de conformité.

(3) S’il estime, à l’issue d’une vérification de conformité, qu’une institution ne s’est pas conformée à la présente loi, le commissaire présente à la personne responsable de l’institu- tion un rapport qui comporte ses conclusions et toutes recommandations qu’il estime appro- priées. Conditions

Short title

(4) In the report, the Commissioner may require the institution to give him or her, within a specified time, (

a) notice of any action taken or proposed to implement the Commissioner’s rec- ommendations; or (

b) reasons why no such action has been taken or proposed. 10. This Act comes into force on the day it receives Royal Assent. 11. The

short title of this Act is the Privacy Enforcement and Accountability Act (Informa- tion and Privacy Statute Law Amendment), 2000.

(4) Dans son rapport, le commissaire peut exiger de l’institution qu’elle lui donne, dans le délai précisé :

a) soit un avis des mesures prises ou pro- posées afin de mettre en oeuvre les re- commandations du commissaire;

b) soit les motifs pour lesquels de telles mesures n’ont pas été prises ni propo- sées. 10. La présente loi entre en vigueur le jour où elle reçoit la sanction royale. 11. Le

titre abrégé de la présente loi est Loi de 2000 sur le respect de la vie privée et sur l’obligation de rendre des comptes à cet égard (modification de lois en ce qui concerne l’accès à l’information et la protection de la vie privée) . Idem Entrée en vigueur
