On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Water Sustainability Regulation, B.C. Reg. 36/2016, is amended as set out in the attached

Schedule A, and

(

b) the Water Sustainability Fees, Rentals and Charges Tariff Regulation, B.C. Reg. 37/2016, is amended as set out in the attached

Schedule B.

Schedule A

1 The Water Sustainability Regulation, B.C. Reg. 36/2016, is amended

(

a) by adding the following section:

Exemption – mine drainage works

34.1

(1) In this section:

“mine” has the same meaning as in

section 1 of the Mines Act ;

“mine drainage works” means works, including a drainage well as defined in

section 35, located in or at a mine and used or intended to be used for diverting groundwater by discharging the groundwater from the mine to prevent interference with the operation of the mine and protect the mine.

(2) A person is exempt from the requirement under

section 6 (1) [use of water] of the Act to hold an authorization for the diversion of groundwater from an aquifer using mine drainage works if

(

a) there is no use of the groundwater for a water use purpose between the time the groundwater is diverted and the time the groundwater is discharged, and

(

b) that groundwater is discharged without causing a significant risk of harm to public safety, the environment, land or other property. ,

(

b) in

section 55 (3) by striking out “ December 31, 2017 ” and substituting “ March 1, 2019 ”, and

(

c) in

section 56 (2) by striking out “ December 31, 2017 ” and substituting “ December 31, 2018 ”.

Schedule B

1 The Water Sustainability Fees, Rentals and Charges Tariff Regulation, B.C. Reg. 37/2016, is amended in column 3 of Table 3 of

Schedule 1

(

a) opposite “ 250 ” in column 2 by striking out “ 500 ” and substituting “ 125 ”,

(

b) opposite “ 500 ” in column 2 by striking out “ 500 ” and substituting “ 250 ”, and

(

c) opposite “ 5 000 ” in column 2 by striking out “ 500 ” and substituting “ 1 000 ”.
