Wall, Que·en's Printer, EdInlOnton BILL 11 THE PUBLIC HIGHWAYS DEVELOPMENT AMENDMENT ACT, 1972 (Assented to , 1972) HER MAJ.ESTY, by and with the advice and consent of the Legislative Assembly of Alberta, enacts as follows: 1. The Public Highways Development Act is hereby amended. 2.

Section is amended (

a) by adding the following subsection after subsec tion (1) :

(1.1) Where there is any property, equipment, materials or other thing within the distance from a 'ControUed highway prescribed in the regulations under

section 26, the Minister may require the owner ther·eof to remove the property, equipment, materials or other thing beyond the distance pre scribed in the regulations within the time pre scribed in the notice. (b) subsection (2) is amended by adding after the words "subs·eotion (1)" the words "or subsection (1.1)". 3. This Act comes into force on the day upon which it is assented to. Explanatory Notes I. This Bill will amend

chapter of the Revised Statutes of Alberta 1970. 2. Section 31 (1) presently reads: 31.

(1) The Minister may, by notice, require an owner of land to m·ove, remove or alter (

a) any thing placed, ,erected, enlarged, extended, re-erected, con structed 'or d:isplayed 'On the land within the distance from a con trolled highway prescribed in the regulations made under

section 26, or (

b) any means of access eonstructed or maintained on the land provtding direct access t'0 a controlled highway, as specified in the notice within the time prescribed in the notice or any exte,nsion thereof allowed by the Minister.
