Section 1 of the Gaming Control Act,

chapter G-1.5 of the Acts of New Brunswick, 2008, is amended by adding the following

definitions in alphabetical or- der: 1 L’article 1 de la

(SLA) “casino operator” means a person who operates a ca- sino under an agreement entered into under paragraph 7(b). (exploitant d’un casino) « exploitant d’un casino » Personne qui exploite un casino conformément à un accord conclu en vertu de l’alinéa 7b). (casino operator) « SLA »

section 25 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 25 : Immunity Immunité de poursuite 25.1(1) No action, application or other proceeding lies or shall be instituted against the Minister, the Crown in right of the Province, the Corporation, a casino operator or the ALC, or an officer, director, employee or agent of any of them, as a direct or indirect result of or arising from the conduct and management of a lottery scheme by the Corporation or the ALC. 25.1(1) Bénéficient de l’immunité de poursuite enga- gée par voie d’action ou autre instance le ministre, la Couronne du chef de la province, la Société, l’exploitant d’un casino et la SLA ainsi que leurs dirigeants, admi- nistrateurs, employés et mandataires pour tout ce qui dé- coule, directement ou indirectement, de la tenue ou de la gestion d’une loterie par la Société ou la SLA ou qui y est attribuable d’une quelconque façon. 1

25.1(2) Subsection (1) does not relieve the ALC or an officer, director, employee or agent of the ALC of any li- ability to which any of them would otherwise be subject in respect of an action for damages arising from a negli- gent act or omission of the ALC or the officer, director, employee or agent in the conduct and management of a lottery scheme. 25.1(2) Le paragraphe (1) ne soustrait pas la SLA ni ses dirigeants, administrateurs, employés ou mandataires de la responsabilité à laquelle ils seraient autrement te- nus relativement à une action en dommages-intérêts qui naît par suite d’actes ou d’omissions commis par négli- gence dans la tenue ou la gestion d’une loterie. 25.1(3) Subsection (1) does not relieve a casino opera- tor or an officer, director, employee or agent of a casino operator of any liability to which any of them would oth- erwise be subject in respect of an action for damages arising from a negligent act or omission of the casino op- erator or the officer, director, employee or agent in oper- ating the casino. 25.1(3) Le paragraphe (1) ne soustrait pas l’exploitant d’un casino ni ses dirigeants, administrateurs, employés ou mandataires de la responsabilité à laquelle ils seraient autrement tenus relativement à une action en dommages- intérêts qui naît par suite d’actes ou d’omissions commis par négligence dans l’exploitation d’un casino. 25.1(4) Nothing in subsection (2) makes the ALC or an officer, director, employee or agent of the ALC liable for punitive damages or exemplary damages in an action for damages referred to in that subsection. 25.1(4) Le paragraphe (2) n’a pas pour effet de rendre la SLA ou l’un de ses dirigeants, administrateurs, em- ployés ou mandataires responsable de dommages- intérêts punitifs ou exemplaires dans une action en dommages-intérêts visée à ce paragraphe. 25.1(5) Nothing in subsection (3) makes a casino oper- ator or an officer, director, employee or agent of a casino operator liable for punitive damages or exemplary dam- ages in an action for damages referred to in that subsec- tion. 25.1(5) Le paragraphe (3) n’a pas pour effet de rendre l’exploitant d’un casino ou l’un de ses dirigeants, admi- nistrateurs, employés ou mandataires responsable de dommages-intérêts punitifs ou exemplaires dans une ac- tion en dommages-intérêts visée à ce paragraphe. 25.1(6) An action for damages referred to in subsec- tion (2) or (3) shall not be instituted under the Class Pro- ceedings Act or as part of any other representative pro- ceeding. 25.1(6) Aucune action en dommages-intérêts visée au paragraphe (2) ou (3) ne peut être intentée en vertu de la

Section 2 of New Brunswick Regulation 2008-112 under the Gaming Control Act is amended by repealing the definition “ALC”. 4 L’article 2 du Règlement du Nouveau- Brunswick 2008-112 pris en vertu de la

Section 2 of New Brunswick Regulation 2008-113 under the Gaming Control Act is amended by repealing the following
