Section of the Environment Act CANADA PROVINCE OF NOVA SCOTIA IN THE MATTER OF:t h e Environment Act of Nova Scotia, S.N.S 1994-95, c.1, s. 106 IN THE MATTER OF: the cancellation of a portion of a designation of an area surrounding Snides Lake in Hants County comprising the Shubenacadie Watershed Area CANCELLATION OF A PART OF THE DESIGNATION RESPECTING THE SHUBENACADIE WATERSHED AREA

WHEREAS by order dated February 22, 1968, and published in the Royal Gazette on February 28, 1968, the Nova Scotia Water Authority defined and prescribed an area surrounding Snides Lake as the Shubenacadie Watershed Area; AND

WHEREAS the following regulations were made by Glen Bagnell, the Minister charged with the administration of the Water Act on April 28, 1972, and published in the Royal Gazette on August 2, 1972; 1. No person shall hunt or trap or carry or discharge a firearm within the Shubenacadie Watershed Area. 2. No person shall camp, picnic or ma ke open fires within the Shubenacadie Watershed Area. 3.

No person shall operate or cause or permit to be operated within the Shubenacadie Watershed Area any self-propelled or motorized vehicle or motorized sled designed to be driven exclusively or chiefly on snow or ice or both. 4. No person shall permit or cause any cow, sheep, horse, pig or any other domesticated animal to graze or to be present within the Shubenacadie Watershed Area. 5. No person shall place, deposit, discha rge or permit or cause to be placed, deposited or discharged any rubbish, litter, refuse or other waste material of any kind within the Shubenacadie Watershed Area. 6.

No person shall swim, wash, bathe, boat, fish, or do any other act which may impair the quality of the water in Snydes Lake aforesaid. © NS Registry of Regulations. Web version. 193 N.S. Reg. 62/2002 ROYAL GAZETTE

No person shall remove water from Snydes Lake aforesaid for any purpose, excepting that water may be removed therefrom by the Municipality of the District of East Hants by means of the water works operated at or near Snydes Lake aforesaid by the said Municipality. . 8. No person shall permit or cause any cow, sheep, horse, pig, or any other domesticated animal to drink or to take water from Snydes Lake aforesaid. 9. No person shall place, deposit, discha rge, or allow to remain in Snydes Lake aforesaid, any material of any kind that may impair the quality of the water therein. AND

WHEREAS subsections 106(4) and (5) of the Environment Act provide:

(4) When requested by an operator of a water works or proposed water works, the Minister may cancel a designation made pursuant to this Section, in whole or in part.

(5) Any protected water area designated pursuant to the Water Act prior to the coming into force of this Act remains so designated. AND

WHEREAS portions of lands included in the order defining and prescribing the Shubenacadie Watershed Area do not form part of the surface watershed of Snides Lake, and the Municipality of the District of East Hants, as operator of the water works of the Shubenacadie Water Utility, has requested the cancellation of those lands from the Shubenacadie Watershed area; THEREFORE the undersigned, the Minister of Environment and Labour hereby cancels that portion of the February 22, 1968 designation which does not form part of the surface watershed of Snides Lake, and the area of land hereinafter described remains designated as a protected water area pursuant to subsection 106(5) of the Environment Act and the regulations remain in force with respect thereto; All that area of land situate at Shubenacadie, in the County of Hants, Province of Nova Scotia, being more particularly bounded and described as follows: BEGINNING at a point on the west boundary line of Highway being distant 958.161 meters on an azimuth of 200° 12' 24" from Nova Scotia Co- ordinate Monument #24070; THENCE 02° 58' 43" a distance of 50.395 meters along the said highway boundary to the beginning of a curve to the right; THENCE northerly an arc distance of 100.075 meters along the said curve having a radius of 507.557 meters and chord distance of 99.913 meters on an azimuth of 08° 37' 37" to a point; THENCE 281° 44' 55" a distance of 89.389 meters to a point; THENCE 286° 02' 03" a distance of 107.988 meters to a point; THENCE 284° 47' 48" a distance of 129.487 meters to a point; THENCE 267° 26' 41" a distance of 72.723 meters to a point; © NS Registry of Regulations.
