B.C. Reg. 297/2010 , deposited October 8, 2010, pursuant to the PUBLIC HEALTH ACT [Sections 111, 115 and 126]. Order in Council 623/2010, approved and ordered October 7, 2010.
On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Health Act Fees Regulation, B.C. Reg. 274/92, is amended as set out in the attached Schedule.

Schedule
Section 1 of the Health Act Fees Regulation, B.C. Reg. 274/92 is amended
(
a) by repealing paragraph (
a) of the definition of " operating permit " , and
(
b) by repealing the
definitions of " operator " , " pool ", and " swimming pool " .
Section 3 is amended
(
a) in subsection (1) by striking out " an operator or " and substituting ", a ",
(
b) in subsection (1) (
b) by striking out " operator or " and " swimming pool or ", and
(
c) in subsection (4) by striking out " operator or ".
Section 4 (1) is amended
(
a) by striking out " an operator or " and substituting " a ", and
(
b) by striking out " operator or ".
Section 6 is amended
(
a) by striking out " swimming pool or ", and
(
b) in paragraph (
a) by striking out " operator or ".
5 The
Schedule is amended
(
a) by repealing
section 1 (1) (a), and
(
b) by repealing
section 2.1 and substituting the following:
2.1 If a proprietor intends to operate more than one restaurant, each of which is located either in or adjacent to a single building or on a site that has a hotel, the proprietor must pay
(
a) the fee as determined under
section 1 (1) (
b) for the restaurant having the highest number of seats, and
(
b) a fee of $75 for each of the remaining restaurants.
