An Act to Amend the Emergency 911 Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Emergency 911 Act,

chapter E-6.1 of the Acts of New Brunswick, 1994, is amended by adding after sec- tion 3 the following: 3.1 Unless a telecommunications service provider has entered into an agreement with the Minister under

section 4.1 and the agreement is valid and of full force and effect, the telecommunications service provider shall bill and collect fees for the NB 911 service from subscribers of the telecommunications service provider and remit the fees to the Province in accordance with the regulations. 2

Section 4.1 of the Act is amended (

a) by repealing subsection (1) and substituting the following: 4.1(1) The Minister may enter into an agreement with a telecommunications service provider in relation to the billing, collecting and remitting of fees for the NB 911 service that the telecommunications service provider shall bill and collect from subscribers of the telecommunica- tions service provider and remit to the Province. chapitre E-6.1 des Lois du Nouveau-Brunswick de 1994, est modifiée par l’adjonction, après l’article 3, de ce qui suit : 3.1 Sauf si le fournisseur de service de télécommunica- tions a conclu une entente avec le Ministre aux termes de l’article 4.1 et que l’entente est valide et en vigueur, le fournisseur de service de télécommunications doit impo- ser et percevoir auprès de ses abonnés les droits pour le service d’urgence 911, N.-B. et remettre ces droits à la province conformément aux règlements. 2 L’article 4.1 de la Loi est modifié

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 4.1(1) Le Ministre peut conclure une entente avec un fournisseur de service de télécommunications relative- ment à l’imposition, la perception et la remise des droits pour le service d’urgence 911, N.-B. que le fournisseur de service de télécommunications doit imposer et percevoir auprès de ses abonnés et remettre à la province.

b) by adding after subsection (1) the following: 4.1(1.1) A telecommunications service provider that en- ters into an agreement with the Minister under subsection (1) shall comply with the terms and conditions of the agreement. 3

Section 6 of the Act is amended by adding before subsection (1) the following: 6(0.1) A person who violates or fails to comply with

section 3.1 or subsection 4.1(1.1) of this Act commits an offence that is punishable under

Part II of the Provincial Offences Procedure Act as a category I offence. 4

Section 8 of the Act is amended (

a) by repealing paragraph (k.1) and substituting the following: (k.1) prescribing fees to be billed, collected and re- mitted for the NB 911 service; (

b) by adding after paragraph (k.1) the following: (k.2) respecting the billing, collecting and remitting of fees for the NB 911 service for the purposes of sec- tion 3.1, including the terms and conditions to be com- plied with by a telecommunication service provider; COMMENCEMENT 5 This Act or any provision of it comes into force on a day or days to be fixed by proclamation.

Partie II de la

Loi sur la procédure appli- cable aux infractions provinciales , à

titre d’infraction de la classe I. 4 L’article 8 de la Loi est modifié

a) par l’abrogation de l’alinéa k.1) et son remplace- ment par ce qui suit : k.1) prescrivant les droits à imposer, percevoir et re- mettre pour le service d’urgence 911, N.-B.;

b) par l’adjonction, après l’alinéa (k.1), de ce qui suit : k.2) concernant l’imposition, la perception et la re- mise des droits pour le service d’urgence 911, N.-B. aux fins de l’article 3.1, y compris les modalités et con- ditions que le fournisseur de service de télécommuni- cations doit observer; ENTRÉE EN VIGUEUR 5 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur à la date ou aux dates fixées par proclamation.

An Act to Amend the Emergency 911 Act Bill 74 EXPLANATORY NOTES

Section 1 New provision.

Section 2 (

a) The existing provision is as follows: 4.1(1) The Minister may enter into an agreement with a telecommu- nications service provider in relation to the collection of fees by a tele- communications service provider from subscribers of a telecommuni- cations service provider for the NB 911 service. (

b) New provision.

Section 3 New provision.

Section 4 (

a) The existing provision is as follows: 8 The Lieutenant-Governor in Council may make regulations… (k.1) prescribing fees to be collected for the NB 911 service; (

b) Regulation-making authority is added.

Section 5 Commencement. NOTES EXPLICATIVES

b) Un pouvoir de réglementation est ajouté.
