Highway Traffic Amendment Act, 1996

EXPLANATORY NOTE

The Highway Traffic Act provides for the suspension of a person's driver's licence for a specific period of time if the person is convicted of an offence under the Criminal Code (Canada) for driving while impaired by alcohol

or a drug. The Bill would require the person to successfully complete a course respecting drug or alcohol abuse before the suspension is lifted.

An Act to amend the Highway Traffic Act

Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows:

Section 41 of the Highway Traffic Act is amended by adding the following subsection:

Reinstatement of licence

(9) If a person's driver's licence is suspended under this

section as a result of a conviction under

section 253, 254 or 255 of the Criminal Code (Canada), the person's driver's licence shall continue to be suspended until the day that

is the later of,

(

a) the day the person demonstrates to the Registrar that the person has successfully completed a course respecting drug or alcohol abuse that is offered by an agency or person approved by the Registrar; and

(

b) the end of the period otherwise provided for under this section.

Commencement

2. This Act comes into force on the day it receives Royal Assent.

short title of this Act is the Highway Traffic Amendment Act, 1996 .
