(AR 211/2004) is amended by this Regulation.

Section 10 is repealed and the following is substituted:

Trustee Act

10 The Trustee Act does not apply to the trustee of a security

deposit trust account.

3 This Regulation comes into force on the coming into

force of the Trustee Act, SA 2022 cT-8.1.

is amended by this Regulation.

Access to learning

5.1 An operator may not deny a child access to an early childhood

services program if the child does not wear a face mask or other face

covering for the primary purpose of preventing or limiting the spread

of COVID-19 or any other communicable disease, as defined in the

Public Health Act.

PRIVATE SCHOOLS AMENDMENT REGULATION

section 29 of the Education Act.

1 The Private Schools Regulation (AR 127/2022) is

amended by this Regulation.

Section 1(1) is amended by adding the following after

clause (b):

(b.1) "at-home learning" means teacher-directed education

programming provided by an operator of a registered private

school, an accredited private school or a funded private

school to a student on a temporary basis at the student's

residence or at a location other than the student's regularly

attended school;

3 The following is added after

section 3:

In-person learning

3.1(1) Subject to subsection (4), in fulfilling its responsibility to

provide students with an education program consistent with the

requirements set out in the Act and the regulations, the operator of a

registered private school offering or providing in-person learning for

some or all of grades 1 to 12 may offer or provide at-home learning

only if the operator provides or continues to provide an option for

in-person learning for each student at the student's regularly attended

school for all grades for which that operator offers or provides

at-home learning.

(2) Subject to subsection (4), the option for in-person learning must

allow the student to continue with the same courses and education

program that the student is enrolled in as of the date at-home

learning is offered or provided.

(3) In fulfilling its responsibility to provide students with an

education program consistent with the requirements set out in the

Act and the regulations, the operator of a registered private school

may not deny a student access to in-person learning if the student

does not wear a face mask or other face covering for the primary

purpose of preventing or limiting the spread of COVID-19 or any

other communicable disease, as defined in the Public Health Act.

(4) The Minister, by order, may exempt the operator of a registered

private school from the application of subsection (1) or (2), subject to

16.1(1) Subject to subsection (4), in fulfilling its responsibility to

provide students with an education program consistent with the

requirements set out in the Act and the regulations, the operator of a

funded private school offering or providing in-person learning for

some or all of grades 1 to 12 may offer or provide at-home learning

only if the operator provides or continues to provide an option for

in-person learning for each student at the student's regularly attended

school for all grades for which that operator offers or provides

at-home learning.

(2) Subject to subsection (4), the option for in-person learning must

allow the student to continue with the same courses and education

program that the student is enrolled in as of the date at-home

learning is offered or provided.

(3) In fulfilling its responsibility to provide students with an

education program consistent with the requirements set out in the

Act and the regulations, the operator of a funded private school may

not deny a student access to in-person learning if the student does

private school from the application of subsection (1) or (2), subject

Definition

1 In this Regulation, "at-home learning" means teacher-directed

education programming provided by a board to a student on a

temporary basis at the student's residence or at a location other than

the student's regularly attended school.

In-person learning option required

2(1) Subject to

section 4, in fulfilling its responsibility to deliver

appropriate education programming, a board offering or providing in-

person learning for some or all of grades 1 to 12 may offer or provide

at-home learning only if the board provides or continues to provide an

option for in-person learning for each student at the student's regularly

attended school for all grades for which that board offers or provides

at-home learning.

(2) Subject to

section 4, the option for in-person learning must allow

the student to continue with the same courses and education program

that the student is enrolled in as of the date at-home learning is offered

or provided.

Access to learning

3 In fulfilling its responsibility to deliver appropriate education

programming, a board may not deny a student access to in-person

learning if the student does not wear a face mask or other face covering

for the primary purpose of preventing or limiting the spread of

COVID-19 or any other communicable disease, as defined in the

Public Health Act.

Exemption from regulation

4 The Minister, by order, may exempt a board from the application of

appropriate.

Expiry

5 For the purpose of ensuring that this Regulation is reviewed for

ongoing relevancy and necessity, with the option that it may be

repassed in its present or an amended form following a review, this

Regulation expires on August 31, 2025.

Education Act

CHARTER SCHOOLS AMENDMENT REGULATION

1 The Charter Schools Regulation (AR 85/2019) is

amended by this Regulation.

Section 12 is amended by renumbering it as

section

12(1) and by adding the following after subsection (1):

(2) In subsections (3) and (4), "at-home learning" means

teacher-directed education programming provided by a charter board

to a student on a temporary basis at the student's residence or a

location other than the student's regularly attended school.

(3) Subject to subsection (6), in fulfilling its responsibility to deliver

appropriate education programming, a charter board offering or

providing in-person learning for some or all of grades 1 to 12 may

offer or provide at-home learning only if the board provides or

continues to provide an option for in-person learning for each student

at the student's regularly attended school for all grades for which that

board offers or provides at-home learning.

(4) Subject to subsection (6), the option for in-person learning must

allow the student to continue with the same courses and education

program that the student is enrolled in as of the date at-home learning

is offered or provided.

(5) In fulfilling its responsibility to deliver appropriate education

programming, a charter board may not deny a student access to

in-person learning if the student does not wear a face mask or other

face covering for the primary purpose of preventing or limiting the

spread of COVID-19 or any other communicable disease, as defined in

the Public Health Act.

(6) The Minister, by order, may exempt a charter board from the

the Minister considers appropriate.

Real Estate Act

REAL ESTATE (MINISTERIAL) AMENDMENT REGULATION

Reduction (M.O. No. SA:014/2022) on November 28, 2022 pursuant to

section 84(2)

of the Real Estate Act.

1 The Real Estate (Ministerial) Regulation (AR 113/96) is

amended by this Regulation.

Section 25.2(1) is repealed and the following is

substituted:

Education and other services

25.2(1) Despite

section 5(

c) of the Act,

(

a) the Board shall not, after December 1, 2022, provide

education services to licensees, and

(

b) subject to subsection (2), the Board shall not provide other

services to licensees,

without the prior written approval of the Minister.

(1.1) An approval by the Minister of the provision of services under

that the Minister considers appropriate.

Section 25.3 is repealed and the following is substituted:

Approval of bylaws and rules

25.3(1) Despite

section 11.01(1) of the Act, the Minister's approval

of a bylaw or the amendment of a bylaw is not required after June

30, 2025.

(2) Despite

section 12.1(1) of the Act, the Minister's approval of a

rule or the amendment of a rule is not required after June 30,
