B.C. Reg. 94/2005, deposited March 18, 2005, pursuant to the EMPLOYMENT AND ASSISTANCE FOR PERSONS WITH DISABILITIES ACT [Section 26]. Order in Council 288/2005, approved and ordered March 17, 2005.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended according to the

schedule to this order.

Schedule

1 The Employment and Assistance for Persons with Disabilities Regulation, B.C. Reg. 265/2002, is amended in

section 1 of

Schedule C by

(

a) repealing the definition "basic dental service" and substituting the following:

"basic dental service" means a dental service that

(

a) if provided by a dentist,

(

i) is set out in the

Schedule of Fee Allowances — Dentist that is effective April 1, 2005 and is on file with the office of the deputy minister, and

(ii) is provided at the rate set out for the service in that Schedule, and

(

b) if provided by a denturist,

(

i) is set out in the

Schedule of Fee Allowances — Denturist that is effective April 1, 2005 and is on file with the office of the deputy minister, and

(ii) is provided at the rate set out for the service in that Schedule; ,

(

b) repealing the definition "dental technician" , and

(

c) amending the definition "emergency dental service"

(

i) in paragraphs (a) (

i) and (b) (

i) by striking out "July 1, 2002" and substituting "April 1, 2005", and

(ii) in paragraph (b) (

i) by striking out "Dental Mechanic" and substituting "Denturist".

Schedule C is amended in

section 4

(

a) in subsection (3) (

c) by adding "or income assistance" after "disability assistance",

(

b) by repealing subsection (5) and substituting the following:

(5) The dental supplements that may be provided to a person described in subsection (3) (b), or to a person described in subsection (3) (

c) who requires a partial denture, are limited to services under

(

a) fee numbers 52101 to 52402 in the

Schedule of Fee Allowances

— Dentist referred to in paragraph (

a) of the definition "basic dental service" in

section 1 of this Schedule, or

(

b) fee numbers 41610, 41612, 41620 and 41622 in the

Schedule of Fee Allowances — Denturist referred to in paragraph (

b) of the definition "basic dental service" in

section 1 of this Schedule. , and

(

c) in subsection (6) by repealing paragraphs (

a) and (

b) and substituting the following:

(

a) fee numbers 51101 and 51102 in the

Schedule of Fee Allowances

— Dentist referred to in paragraph (

a) of the definition "basic dental service" in

section 1 of this Schedule, or

(

b) fee numbers 31310, 31320 or 31330 in the

Schedule of Fee Allowances — Denturist referred to in paragraph (

b) of the definition "basic dental service" in

section 1 of this Schedule.

Schedule C is amended in

section 4.1

(

a) in subsection (1) (

a) by striking out "a general practice dentist or dental surgeon" and substituting "a dentist",

(

b) in subsection (1) (

b) by striking out "was effective December 1, 2003" and substituting "is effective April 1, 2005", and

(

c) in subsection (2) (

a) by striking out "on pages 5 to 7 of the

Schedule of Fee Allowances

— General Practice" and substituting "under the Restorative Services

section of the

Schedule of Fee Allowances

— Dentist".
