Mr Jack Carroll (Chatham-Kent): On a point of order, Chair: I wonder if you might help me with this. Does the fact that there are at least all the time five members opposite standing represent an automatic call for a division before you ask for the ayes and the nays?

The Chair: Member for Chatham-Kent, when I ask the question, first of all I hear "yes," and I hear "nay," and then I turn around and I see them standing up and they're all in favour of the vote. It's not the division, it's not a division vote. They stand up because they are in favour of the motion. If you object to it --

Mrs Boyd: We can't hear you, Mr Chair.

The Chair: I'm sorry. The question was asked, how come you're all standing up instead of sitting down and going up and down all the time? What I said was that I hear "aye" and I hear "nay," and at the time I look at the nays I turn around and they're there and they voted. I don't see anything wrong with that.

Mr Carroll: Mr Chair, could I just ask you another thing. Do I understand then from your ruling that if you don't hear any --

The Chair: It's not a ruling, it's just --

Mr Carroll: Your

interpretation then -- that if you don't hear any nays it's automatically a request for a division anyway because there are five people standing?

The Chair: I do the same thing with you too. I know for a fact that automatically it's going to be a nay, so I don't want to be too technical. Either we go through it and I could take my time and go very slowly at it -- if I hear no nays I will assume that the motion's carried.

Mr Carroll: Your ruling is if there are five people standing in their place it's not a request for a division.

The Chair: No.

Mr Carroll: Can you explain why not?

The Chair: I explained well. I try to be fair. I think you must admit that. I don't think I made any mistakes so far and I would like to continue that way. But if you don't like it that way, I'm in your hands. You're the boss; I'm not. So we'll keep on. Are you clear and satisfied?

Mr Doug Galt (Northumberland): On a point of order, Chair: I'm still confused on this particular order, the fact that there are five people standing when you ask "Shall the motion carry?" and they've already asked for a division, I do not understand why it's necessary to ask for the ayes and nays. If they're standing and they've asked for a division, we should just proceed to the fact that the vote is deferred.

The Chair: To the member for Chatham-Kent and the member for Northumberland, when I hear a "nay" here I look there and they're standing up. They're behind their seats and they're just standing up. It's as simple as that.

Mr Len Wood (Cochrane North): On a point of order, Chair: It's quite clear that you've explained this clearly. The way I understand it is if there were no nays over there, you would not have to have a standing vote to have it deferred, on this side. The reason we're standing is because as the vote is called we're standing five members to have it deferred. If there were no nays, there would be no problem.
