The Governor in Council on the report and recommendation of the Minister of

Transportation dated the 4th day of June, 1987, pursuant to subsection (3B) of

Section

131A of

Chapter 191 of the Revised Statutes of Nova Scotia, 1967 [Section 145(5),

R.S.N.S. 1989, c. 293], the Motor Vehicle Act, is pleased to authorize the Minister of

Transportation on behalf of Her Majesty the Queen in right of the Province of Nova

Scotia to enter into a reciprocal agreement with the State of Florida, respecting

handicapped parking, substantially in the form set out in

Schedule "A", or in such form

as counsel for the Attorney General may advise.

Memorandum of Understanding Regarding

Parking Privileges for Vehicles Displaying

WHEREAS the Florida Vehicle Law provides that the State of Florida may

designate parking spaces for use by a person who has been issued a special registration

plate for disabled persons or a disabled person's parking permit;

AND

WHEREAS, in Florida, the person for whom a special plate or a disabled

person's parking permit is issued

(

a) may park in specially designated and marked motor vehicle parking

spaces reserved for their use,

(

b) may park without the payment of any fees on the public streets or

highways of the State of Florida, and

(

c) is not required to pay any parking meter fees of the state, any county,

municipality, or any agency of the State of Florida;

AND

WHEREAS the Province of Nova Scotia wishes to extend to persons to

whom a special plate or a disabled person's parking permit has been issued by the State

of Florida the same rights and privileges as granted to residents of Nova Scotia issued

like plates or identification permits in the Province of Nova Scotia.

NOW THEREFORE, the parties to this reciprocal agreement hereby agree that the

State of Florida shall provide by this common "Memorandum of Understanding" that

recognition shall be provided to a person for whom special plates or a disabled person's

parking permit are issued entitling such person to certain privileges, regardless of

whether the special plate or disabled person's parking permit is issued under Florida

Vehicle Law or the like provisions of

Section 131A of the Motor Vehicle Act, R.S.N.S.

1967, c. 191 of the Province of Nova Scotia, [Section 145, R.S.N.S. 1989, c. 293] and

that such privileges shall be granted only when the vehicle used by such a handicapped

person is properly identified by some special license plate, tab, device, identification

card, placard, or other visible means of identification, issued by the Province of Nova

Her Majesty the Queen in Right of the Province of Nova Scotia, by Her Governor

in Council, in Orders in Council Nos. 86-1055 and 86-1056 on the report and

recommendation of the Minister of Transportation has caused regulations to be made

pursuant to

Section 131A(1) of

Chapter 191 of the Revised Statutes of Nova Scotia,

1967, the Motor Vehicle Act, [Section 145(1), R.S.N.S. 1989, c. 293], said regulations

being attached hereto as

Schedule "A" to this Memorandum of Understanding, now

authorizes a Reciprocal Agreement with the State of Florida with respect to

identification permits and plates issued by the State of Florida respecting handicapped

parking whereby an identification permit or plate issued by the State of Florida shall be

deemed to be an identification permit or plate issued pursuant to the regulations in and

for Her Majesty's Province of Nova Scotia pursuant to

Section 131A(3B) [145(5)] of

the said Act.

This Memorandum of Understanding shall become effective on the lst day of

September, 1987 and shall be in force thereafter until modified or cancelled.

The Governor in Council on the report and recommendation of the Minister of

Transportation and Communications dated the 12th day of September, 1989, pursuant

to subsection (3B) of

Section 131A of

Chapter 191 of the Revised Statutes of Nova

Scotia, 1967, [Section 145(5), R.S.N.S. c. 293], the Motor Vehicle Act, and every other

power and authority in him vested in this behalf, is pleased to authorize the Minister of

Transportation and Communications on behalf of Her Majesty the Queen in right of the

Province of Nova Scotia to enter into reciprocal agreements with the States of Illinois,

Maine, Oregon, Minnesota and Ohio and the Commonwealths of Puerto Rico and

Kentucky respecting handicapped parking in the form set out in Schedules "A" to "G",

inclusive, attached to and forming part of the report and recommendation, or as counsel

for the Attorney General may advise.

Schedule "A" to O.I.C. 89-1197

Reciprocal Handicapped Parking Agreement

WHEREAS,

Section 11-1301.4 of the Illinois Vehicle Code (Public Act 84-868),

provides that the Secretary of State, or his designee, may enter into agreements with

other jurisdictions, including foreign jurisdictions, on behalf of this State relating to the

extension of parking privileges by such jurisdictions to permanently disabled residents

of this State who display international wheelchair plates or a distinguishing insignia on

his or her motor vehicle, and to recognize international wheelchair plates or the

distinguishing insignia placard issued by such other jurisdictions; and

WHEREAS, the State of Illinois may grant the same parking privileges which are

granted to disabled residents of this State to any non-resident whose motor vehicle is

licensed in another state or foreign country if such vehicle displays the international

wheelchair plates or the distinguishing insignia placard issued in accordance with the

laws of the non-resident's state or foreign country;

NOW THEREFORE, the Province of Nova Scotia agrees to grant the same parking

privileges to handicapped persons who are residents of the State of Illinois as are

extended to handicapped persons who are residents of the Province of Nova Scotia.

The State of Illinois, in turn, agrees to grant the same parking privileges to

handicapped persons who are residents of the Province of Nova Scotia, as are extended

to handicapped persons who are residents of the State of Illinois. Such privileges will

be granted by both jurisdictions only when the vehicle used by such a handicapped

person is properly identified by some special license plate, symbol, tab device,

identification card, placard, or other visible means of identification issued by the

resident jurisdiction.

This agreement shall become effective upon the signature of both jurisdictions, and

shall be in force thereafter until modified or cancelled by either party upon thirty days

written notice.

Canadian Province - State Agreement

State of Maine

Memorandum of Understanding Regarding

Parking Privileges for Vehicles Displaying

WHEREAS, the Maine Vehicle Law provides that the State of Maine may

designate parking spaces for use by a person who has been issued a special registration

plate for disabled persons or a disabled person's parking permit.

WHEREAS, the State of Maine will provide by a common "Memorandum of

Understanding" that mutual recognition may be provided to a person for whom special

plates or a disabled person's parking permit are issued entitling such person to certain

privileges, regardless of whether the special plate or disabled person's parking permit is

issued under Main Vehicle Law or a similar provision of any Canadian province.

WHEREAS, in Maine, the person for whom a special plate or a disabled person's

parking permit is issued

1 may park in specially designated and marked motor vehicle parking

spaces reserved for their use;

2 may park without the payment of any fees on the public streets or

highways of this state; and

3 is not required to pay any parking meter fees of the state, any county,

municipality, or any agency of this state.

WHEREAS, the provisions of the Maine Vehicle Law cited in paragraph 3

supersede any local ordinance, except that they do not apply

1 to clearly defined bus loading zones, fire zones, or areas posted as "No

Parking" zones; or

2 where there is a local ordinance that prohibits parking during heavy

traffic periods in morning, afternoon, or evening rush hours, or where

parking clearly would present a traffic hazard.

WHEREAS, both the Canadian Province of Nova Scotia and the State of Maine

extend certain parking privileges to handicapped persons displaying distinguishing

license plates or identification cards or placards; and

WHEREAS, the Canadian Province of Nova Scotia and the State of Maine, in

order to effectuate an understanding of reciprocal parking privileges for handicapped

persons, declare it to be in the best interests of the Canadian Province of Nova Scotia

and the State of Maine to enter into such understanding.

NOW THEREFORE, the Canadian Province of Nova Scotia agrees to grant the

same parking privileges to handicapped persons who are residents of the State of Maine

as are extended to handicapped persons who are residents of the Canadian Province of

Nova Scotia. The State of Maine agrees to grant the same parking privileges to

handicapped persons who are residents of the Canadian Province of Nova Scotia as are

extended to handicapped persons who are residents of the State of Maine. Such

privileges will be granted only when the vehicle used by such a handicapped person is

properly identified by some special license plate, tab, device, identification card,

placard, or other visible means of identification, issued by the resident jurisdiction and

WHEREAS, the Minnesota Vehicle Law provides that the State of Minnesota

may designate parking spaces for use by a person who has been issued a special

registration plate for disabled persons or a disabled persons parking permit.

WHEREAS, the State of Minnesota will provide by a common "Memorandum

of Understanding" that mutual recognition may be provided to a person for whom

special plates or a disabled person's parking permit are issued entitling such person to

certain privileges, regardless of whether the special plates or disabled person's parking

permit is issued under Minnesota Vehicle Law or a similar provision of any Canadian

province.

WHEREAS, in Minnesota, the person for whom special plates or a disabled

person's parking permit is issued

1 may park in specially designated and marked motor vehicle parking spaces

reserved for their use; and

2 is not required to pay any parking meter fees of the state, any county,

municipality, or any agency of this state except for municipal parking lots or

ramps when there is a charge.

WHEREAS, the provisions of Minnesota Vehicle Law cited in paragraph 3

supersede any local ordinance, except that they do not apply

1 to zones where stopping, standing, or parking is prohibited to all vehicles;

2 where there is a local ordinance that prohibits parking on any street or highway

for the purpose of creating a fire lane, or to provide for the accommodation of

heavy traffic during morning, and afternoon rush hours.

WHEREAS, both the Canadian Province of Nova Scotia and the State of

Minnesota extend certain parking privileges to handicapped persons displaying

distinguishing license plates or identification cards or placards; and

WHEREAS, the Canadian Province of Nova Scotia and the State of

Minnesota, in order to effectuate an understanding of reciprocal parking privileges for

handicapped persons, declare it to be in the best interests of the Canadian Province of

Nova Scotia and the State of Minnesota to enter into such understanding.

NOW THEREFORE, the Canadian Province of Nova Scotia agrees to grant

the same parking privileges to handicapped persons who are residents of the State of

Minnesota as are extended to handicapped persons who are residents of the Canadian

Province of Nova Scotia. The State of Minnesota agrees to grant the same parking

privileges to handicapped persons who are residents of the Canadian Province of Nova

Scotia as are extended to handicapped persons who are residents of the State of

Minnesota. Such privileges will be granted only when the vehicle used by such a

Whereas, the Ohio motor vehicle laws provide that special parking locations and

privileges for handicapped persons will be designated in this state for motor vehicles

displaying a special registration plate or parking card for handicapped persons;

Whereas, the Nova Scotia motor vehicle laws provide that the Province of Nova Scotia

may designate parking spaces for use by a person who has been issued either a special

registration plate for disabled or handicapped persons or a disabled person's placard or

decal;

Whereas, the state of Ohio and the Province of Nova Scotia in order to effectuate a

program of reciprocal agreements for handicapped persons, declare it to be in the best

interests of the State of Ohio and the Province of Nova Scotia to enter into an

agreement;

Whereas, in the Province of Nova Scotia, the person for whom special registration

plates, placards, or decals have been issued is entitled to the following privileges:

Whereas, in the State of Ohio, the person for whom special plates or a handicapped

parking placard has been issued is entitled to the following privileges:

1 may park in specially designated and marked motor vehicle parking spaces

reserved for their use;

2 may park for a period of two hours in excess of the legal parking limit

permitted by local authorities, except where local ordinances or police rules

provide otherwise or where the vehicle is parked in such a manner as to be

clearly a traffic hazard;

3 may not park contrary to a local ordinance that prohibits parking during

heavy traffic periods in morning, afternoon or evening rush hours, or where

parking clearly would present a traffic hazard; and

4 may not park in clearly defined bus loading zones, fire zones, or in areas

posted as "No Parking" zones.

NOW THEREFORE,

1 the Province of Nova Scotia agrees to grant the same parking privileges to

handicapped residents of Ohio as are given to handicapped persons who are

residents of the state of [Canadian Province of Nova Scotia];

2 the State of Ohio agrees to grant the same parking privileges to

handicapped residents of the Province of Nova Scotia as are given to

handicapped persons who are residents of the State of Ohio;

3 such privileges will be granted only if the motor vehicle used by such

handicapped resident is properly identified by some special license plate,

tab, device, identification card, placard, or other visible means of

identification, issued by the resident jurisdiction and such identifying

Declaration of Reciprocity Regarding

the "International Symbol of Access"

WHEREAS, the Puerto Rico Motor Vehicle and Traffic Law provides that the

Commonwealth of Puerto Rico may designate parking spaces for use by a person who

has been issued a special registration plate for disabled persons.

WHEREAS, the Puerto Rico Motor Vehicle and Traffic Law provides that a

person for whom special plates are issued is entitled to certain privileges.

WHEREAS, in Puerto Rico, the person for whom special plates are issued

1 may park in specially designated and marked motor vehicle parking

spaces reserved for their use; and

2 may park without the payment of any fees on the public streets or

highways of this jurisdiction.

WHEREAS, the provisions of the Puerto Rico Motor Vehicle and Traffic Law

cited in paragraph 3 supersede any local ordinance, except that they do not apply

1 to clearly defined bus loading zones, fire zones, or in areas posted as

"No Parking" zones; or

2 where there is a local ordinance that prohibits parking during heavy

Commonwealth of Kentucky

Declaration of Reciprocity Regarding

WHEREAS, the Commonwealth of Kentucky issues special license plates to

motor vehicles owned by or leased by handicapped individuals and to agencies which

serve the handicapped.

WHEREAS, Kentucky statutes allow for the issuance of a special parking

permit to handicapped individuals.

WHEREAS, the Commonwealth of Kentucky and the Province of Nova Scotia,

in order to effectuate a program of reciprocal parking agreements for handicapped

persons, declare it to be in the best interests of the Commonwealth of Kentucky and the

Province of Nova Scotia to enter into such agreement.

THEREFORE, the Commonwealth of Kentucky agrees to grant the same

parking privileges to handicapped persons who are residents of the Province of Nova

Scotia as are extended to handicapped persons who are residents of the Commonwealth

of Kentucky and the Province of Nova Scotia agrees to grant the same parking

privileges to handicapped persons who are residents of the Commonwealth of

Kentucky as are extended to handicapped persons who are residents of the Province of

Nova Scotia. Such privileges will be granted only when the vehicle used by such a

handicapped person is properly identified by a special license plate, tab, device,
