An Act to Amend the Provincial Court Act Loi modifiant la

Loi sur la Cour provinciale Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1 Subsection 7.1(5) of the Provincial Court Act, chap- ter P-21 of the Revised Statutes, 1973, is amended by striking out “19 and 22” and substituting “19, 21.1 and 22”. 1

a) a judge from carrying out any duties assigned to him or her by order of the Lieutenant-Governor in Council;

Part III;

Sous réserve des dispositions du Code criminel (Canada), le juge qui est nommé à un autre tribunal con- naît, pendant la période de douze semaines qui suit la date de sa nomination, des actions, causes, affaires, actes de procédure, audiences et instances dont il était alors saisi. 21.1(2) During the 12-week period referred to in sub- section (1), the judge may continue to hear evidence and argument, decide the action, cause, matter, process, hear- ing or proceeding and make an order, impose sentence or do anything else to complete the action, cause, matter, process, hearing or proceeding as if the judge has not been appointed to another court. 21.1(2) Pendant la période de douze semaines mention- née au paragraphe (1), le juge peut continuer d’instruire la preuve et l’argumentation des parties, de statuer, de rendre une ordonnance, de déterminer la peine ou de prendre toute autre mesure afin de mener à sa conclusion l’action, la cause, l’affaire, l’acte de procédure, l’audience ou l’ins- tance, comme s’il n’avait pas été nommé à un autre tribu- nal. 21.1(3) Sections 3.1, 6 to 6.13, 19 and apply with the necessary modifications to the judge. 21.1(3) Les articles 3.1, 6 à 6.13, 19 et s’appliquent, avec les adaptations nécessaires, au juge.
