EXPLANATORY NOTE The Bill amends the Education Act so that a person whom a Special Education Identification, Placement and Review Committee identifies and places as an exceptional pupil in a school year begin- ning on or after September 1, 1995 may continue to attend school without paying fees until the end of the school year in which the person attains the age of 28 years if the person has not completed an elementary school education. An Act to amend the Education Act with respect to exceptional pupils to allow the Premier to keep his promise to Gordie Kirwan Her Majesty, by and with the advice and consent of the Legislative Assembly of the Province of Ontario, enacts as follows: 1. Subsection 11 (1) of the Education Act, as amended by the Statutes of Ontario, 1993,

chapter 11,

section 11, 1996,

chapter 12,

section 64 and 1997,

chapter 31,

section 7, is further amended by adding the following paragraph: 6.1 governing the identification and place- ment of exceptional pupils for the pur- poses of clause 33 (7) (b).

Section 33 of the Act, as re-enacted by the Statutes of Ontario, 1997,

chapter 31, sec- tion 14, is amended by adding the following subsection:

(7) A person continues to be qualified to be a resident pupil under subsection (1), (2), (3) or (4) until the last school day in June in the year in which the person attains the age of 28 years if, in any school year beginning on or after September 1, 1995, (

a) the person would be qualified under subsection (1), (2), (3) or (4), as appli- cable, but for being over 21 years old; and (

b) a Special Education Identification, Placement and Review Committee established under the regulations that has jurisdiction identifies and places the person, in accordance with the regu- lations, as an exceptional pupil; and (

c) the person has not completed an ele- mentary school education. 3. This Act comes into force on a day to be named by proclamation of the Lieutenant Governor. Projet de loi 49 1998 Loi modifiant la

Loi sur l’édu- cation, tel qu’il est modifié par l’article 11 du

chapitre 11 des Lois de l’Ontario de 1993, par l’article 64 du

chapitre 12 des Lois de l’Onta- rio de 1996 et par l’article 7 du

chapitre 31 des Lois de l’Ontario de 1997, est modifié de nou- veau par adjonction de la disposition sui- vante : 6.1 régir l’identification et le placement des élèves en difficulté pour l’application de l’alinéa 33 (7) b). 2. L’article 33 de la Loi, tel qu’il est adopté de nouveau par l’article 14 du

chapitre 31 des Lois de l’Ontario de 1997, est modifié par ad- jonction du paragraphe suivant :

(7) La personne continue à satisfaire aux conditions requises pour être élève résident aux termes du paragraphe (1), (2), (3) ou (4) jusqu’au dernier jour de classe du mois de juin de l’année où elle atteint l’âge de 28 ans si les conditions suivantes sont réunies dans une an- née scolaire qui commence le 1 er septembre 1995 ou par la suite :

a) la personne satisferait aux conditions requises visées au paragraphe (1), (2), (3) ou (4), selon le cas, si elle n’avait pas plus de 21 ans;

b) un comité d’identification, de place- ment et de révision en éducation de l’enfance en difficulté créé aux termes des règlements et qui est compétent identifie la personne à

titre d’élève en difficulté et la place comme tel confor- mément aux règlements;

c) la personne n’a pas terminé l’école élé- mentaire. 3. La présente loi entre en vigueur le jour que le lieutenant-gouverneur fixe par procla- mation. Élèves en difficulté Entrée en vigueur

short title of this Act is the Gordie Kirwan Education Amendment Act (Excep- tional Pupils), 1998. 4. Le
