Short title

Condominium Regulations, 2011 80/11 The Newfoundland and Labrador Gazette September 16, 2011 440 2. In these regulations, "component" means an individual item that is included in the physical analysis portion of a reserve-fund study as described in

section 4, and shall include an item (

a) that is the responsibility of the corporation, (

b) for which major repair or replacement costs are anticipated to be incurred during its useful life; and (

c) for which the costs of repair or replacement will not be cov- ered as part of the annual operating or maintenance budget. 3. The following classes of persons may prepare a reserve-fund study (

a) a member of the Appraisal Institute of Canada holding the designation of Accredited Appraiser Canadian Institute; (

b) a person licensed under the Architects Act, 2008; (

c) an engineer registered to practice engineering under the En- gineers and Geoscientists Act, 2008; and (

d) a member of the Real Estate Institute of Canada holding the designation of Certified Reserve Planner. 4.

(1) A reserve fund study shall consist of (

a) a physical analysis; (

b) a financial analysis; and (

c) a reserve fund status certificate.

(2) The physical analysis requir ed under paragraph (1)(

a) shall consist of (

a) the component inventory of the corporation; and (

b) an assessment of each compon ent that states the following: (

v) the estimated year for its major repair or replacement, (vi) its estimated cost of major repair or replacement as of the date of the study, and (vii) the percentage of that cost of major repair or replace- ment to be covered by the reserve fund and the adjusted cost resulting from the application of that percentage.

(3) A component that is scheduled for major repair or replace- ment in the year of the reserve fund study is considered to have no re- maining life expectancy.

(4) In preparing the component inventory of the corporation for the purpose of paragraph (2)(a), the person conducting the reserve fund study shall review (

a) the declaration and description; and (

b) the current by-laws or proposed by-laws of the corporation establishing what constitutes a standard unit.

(5) The financial analysis required under paragraph (1)(

b) shall consist of the following: (

a) a description of the financial status of the reserve fund as of the date of the reserve fund study; and (

b) a recommended funding plan projected over a period of at least 30 consecutive years, begi nning with the current fiscal year of the corporation, that shows the minimum balance of the reserve fund during the pe riod and, for each projected year, (

i) the estimated cost of majo r repair or replacement of the common elements and assets of the corporation based

Condominium Regulations, 2011 80/11 The Newfoundland and Labrador Gazette September 16, 2011 442 on current costs for the year in which the study is con- ducted, (ii) the estimated cost of ma jor repair or replacement of the common elements and assets of the corporation at the estimated time of the repair or replacement based on an assumed annual inflation rate, (iii) the annual inflation rate described in subparagraph (ii), (iv) the estimated opening balance of the reserve fund, (

v) the recommended amount of contributions to the reserve fund, determined on a cash flow basis, that are required to adequately offset the expect ed cost in the year of the expected major repair or replacement of each item in the component inventory, (vi) the estimated interest that will be earned on the reserve fund based on an assumed annual interest rate, (vii) the annual interest rate described in subparagraph (vi), (viii) the total of the amounts described in subparagraph (

v) and (vi), (ix) the increase, expressed as a percentage, in the recom- mended amount of contributions to the reserve fund over the recommended amount of contributions for the immediately preceding year, and (

x) the estimated closing ba lance of the reserve fund.

(6) In preparing the financial analysis described in subsection (5), the person conducting the reserve fund study shall review, (

a) the most recent audited fina ncial statements of the corpora- tion or, in the case of a corporation that has as one of its ob- jects the management of a property consisting of less than 10 units, the most recent financial statements of the corporation; and (

b) the most recent reserve fund study of the corporation.

(7) A reserve-fund status certificate required pursuant to para- graph(1)(

c) shall be completed by the person preparing the reserve-fund study at the time the study is completed and shall provide (

a) the balance in the reserve-f und at the beginning of the cur- rent year; (

b) the annual contribution to the reserve-fund recommended to be made during the current and subsequent fiscal years of the study period; (

c) a statement summarizing the repair, maintenance and re- placement recommendations in the study; (

d) the date when a new reserve fund study is required to be completed under subsection 49(5) of the Act; and (

e) the opinion of the person preparing the study that the fund should be adequate to offset the expenditures for the major repair or replacement of the components if the corporation makes contributions as recommended in the study.

(8) The person conducting the reserve fund study shall sign it. 5.

(1) A reserve fund study shall be based on, (

a) a visual site inspection of the property, including a visual inspection of each component where practicable; (

b) all other inspections of each component that the person con- ducting the study considers appropriate or necessary; (

c) a verification of records of the corporation; and (

d) interviews with those of the corporation’s directors, officers, employees and agents that the person conducting the study considers appropriate.

(2) As part of preparing the assessment of each component de- scribed in paragraph 4(2)(b), the person conducting the reserve fund study shall review the following documents: Method of conduct- ing a reserve fund study

a) all existing warranties, guar antees and service contracts for each component; (

b) the as-built architectural, structural, engineering, mechani- cal, electrical and plumbing plans for the property that are in the custody of or under the control of the corporation; (

c) the as-built specifications for the buildings that are in the custody of or under the control of the corporation; (

d) the plans for underground site services, site grading, drain- age and landscaping, and television, radio or other commu- nications services for the proper ty that are in the custody of or under the control of the corporation; (

e) the repair and maintenance records and schedules in the cus- tody of or under the control of the corporation; and (

f) all other records of the corporation that the person conduct- ing the study requires in order to prepare the assessment.

(3) In addition to the material that a reserve fund study is re- quired to contain, the study may contain all further information and analysis that the person conducting the study or the board considers appropriate or necessary. 6. The corporation shall provide a copy of the reserve fund study to each of the unit owners in the property, as soon as the study is com- pleted. 7. A person conducting a reserve fund study shall carry profes- sional liability insurance and shall, when requested by the corporation, submit proof of that insurance. 8.

A person shall not, without the written consent of the owners of all of the units in the property, prepare a reserve fund study for a corpo- ration if that person (

(2) The moose management areas referred to in subsection (1) are described in the Open Season Big Game Moose Hunting Order, Newfoundland, 2011-2012 except that: (

a) Moose Management Area 28 is further described for black bear hunting only, to exclude: All that area of the Island of Newfoundland located in the district of Terra Nova, commenci ng at a point in the centre of the land-fill site at the northwestern edge of Terra Nova National Park; Then extending to a radius of 2 kilometres from that point in all directions, with an area of approximately 1,250 hectares and a perimeter of approximately 12,543 metres; and (

b) moose management sub-areas do not apply to black bear hunting. 3. Only Aldrich foot snares or similar devices may be set for the taking of black bears and those devices shall be set in a covered "cubby set" and clearly marked with a warning sign indicating that a bear snar- ing device is set in the "cubby". Open Season Small Game Hunting and Snaring Order, 2011-2012 83/11 5. Notwithstanding the open seasons described in sections 3 and 4 all small game hunting, shooting, and snaring is prohibited on the fol- lowing islands: Hunting, shooting, and snaring prohib- ited (

a) Kelly’s Island, Conception Bay; and (

b) Brunette Island, Fortune Bay. 6.

(1) The bag limits shall be Bag l imits (

a) for the province, excluding Labrador and the islands adja- cent to Labrador, for shooting and snaring (

i) arctic hare, not applicable, no open season, (ii) snowshoe or varying hare, a possession limit of 40 rab- bits, (iii) ptarmigan (

A) a daily limit of 12 birds and field possession limit of 24 birds except as provided below, and (

B) in the Avalon/Swift Current, Burin and Topsails Areas as described in the

Schedule A a daily limit of 6 birds and field possession limit of 12 birds, and (iv) ruffed grouse and spruce grouse, a daily bag limit of 20 birds with a field possession limit of 40 birds, ruffed and spruce grouse combined; and (

b) for Labrador, and the islands adjacent to Labrador, for shoot- ing or snaring (

i) arctic hare, no limit, (ii) snowshoe or varying hare, no limit, (iii) ptarmigan, daily bag limit of 25 birds with a field pos- session limit of 50 birds, (iv) ruffed and spruce grouse The Newfoundland and Labrador Gazette September 16, 2011 457

A) Northern Labrador, no limit, and (

B) Southern Labrador, daily bag limit of 25 with field possession limit of 50 birds, spruce and ruffed grouse combined, and (

v) porcupine, a possession limit of one porcupine.

(2) Notwithstanding subparagraph (1)(a)(ii), the possession limit does not apply to persons licensed under the Food and Drug Act (Can- ada), who may exceed the bag limit for snowshoe hare on their business premises for commercial purposes. 7. A resident who has resided permanently in the Torngat Moun- tains Electoral District for a peri od of not less than 6 consecutive months immediately prior to applying for the licence, may be issued a small game licence free of charge. Small game licence 8.

Field possession limit refers to the number of birds a small game licence holder may carry while hunting or travelling in the country. Fi eld possession limit 9. A person shall not transport or possess any firearm under the authority of a valid hunting licence without being in possession of an outdoor identification card, or non-resident equivalent, issued to the person. Proh ibition 10 .

Hunting with a firearm on Sundays shall be permitted across the entire province, beginning October 2, 2011 and ending April 30, 2012, for the species and during the season s as described in this Order, in- cluding any prescribed season for wild geese, wild ducks and snipe. Sun day hunting 11 . Approved snaring devices for the province excluding Labrador and the islands adjacent to Labrador may only include A pproved snaring devices (

a) brass wire not larger than 22 gauge attached to a firm an- chor; and (

b) Burin Area All that area of the Island of Newfoundland bounded by a line beginning at the community of Terrenceville; Then following the Terrenceville Highway to its intersection with the Burin Peninsula Highway Route 210; Then following Route 210 in a generally northerly direction to where it crosses the bridge on the Piper’s Hole River; Then following the eastern shore of Piper's Hole River in a southerly direction to its mouth in Placentia Bay; Then following the shoreline of Placentia and Fortune Bay to the point of commencement , excluding all offshore is- lands. (

(3) Notwithstanding subsection (1) and (2), there shall be no open season in Area 43 for moose that are predominately white in color. Proof of sex 4. The holder of a big game licence to hunt, take or kill female only animals shall, upon request of a wildlife officer, produce the head of the animal. 5. The bag limit is one moose as specified in each licence. Bag l imit 6. A person shall not transport or possess any firearms under the authority of a valid game licence without being in possession of an outdoor identification card, or non-resident equivalent card, issued to the person.
