On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended as set out in the attached Schedule.

1 The heading to

Part 1 of the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is repealed and the following substituted:

Part 1 –

Definitions .

Section 14 is amended

(

a) in subsection (2) by striking out “ A licence must not be issued under subsection (1) ” and substituting “ Subject to

section 14.11, a licence must not be issued under subsection (1) ” , and

(

b) in subsection (3) by striking out “ renewed or transferred ” and substituting “ issued, renewed or transferred ” .

3 The following

section is added:

Conversion of wine store licence to licensee retail store licence

14.11

(1) A licensee who holds a wine store licence that permits the licensee to sell all types of wine, except sacramental wine, may, until 4:30 p.m. on March 31, 2025, apply to the general manager for conversion of the wine store licence to a licence in respect of a licensee retail store.

(2) The general manager may approve an application for conversion referred to in subsection (1) and, subject to

section 14 (3), may issue a licence in respect of a licensee retail store in the place of the wine store licence that is the subject of the application on the following conditions:

(

a) the general manager has completed his or her consideration of applications and determinations under

section 14.03;

(

b) subject to subsection (3), the location of the licensee retail store, as proposed on the application for conversion of the wine store licence, is at least 1.0 km from the site of another licensee retail store, a liquor store or the proposed location of another store.

(3) If an application to convert a wine store licence in respect of a licensee retail store does not comply with subsection (2) (b), the general manager may approve that application if the shortest travelling distance by road between the proposed location of the licensee retail store and another licensee retail store, a liquor store or the proposed location of another store is 1.0 km or more because of a natural barrier between the proposed location of the licensee retail store and the other licensee retail store, liquor store or proposed location of another store.
