EXPLANATORY

NOTE

The

Bill amends the Highway Traffic Act to require

police officers and other prescribed persons to gather information about

incidents in which someone is injured or property is damaged following a

potential contravention of clause 165 (1) (

a) of the Act, which requires

individuals to take due precautions when opening the door of a motor vehicle on

a highway, and to report that information to the Registrar of Motor Vehicles.

The Act is also amended to require the Registrar to keep records of and

report on these incidents.

Act to amend the Highway Traffic Act with respect to reporting of incidents of

unsafely opening a motor vehicle door on a highway

Her

Majesty, by and with the advice and consent of the Legislative Assembly of the

Province of Ontario, enacts as follows:

Section 202 of the Highway Traffic Act is amended

by adding the following subsections:

Reporting

re dooring, etc.

(1.1) Every

police officer and every prescribed person having knowledge of a possible contravention

of clause 165 (1) (

a) that resulted in injury to a person or damage to property

shall secure the particulars of the incident, the persons involved, and other

information as may be necessary to complete a written report to the Registrar

on the forms prescribed for that purpose, and shall transmit the report

forthwith to the Registrar.

Regulations

(4) The

Lieutenant Governor in Council may make regulations prescribing anything that

this

section refers to as being prescribed.

(1) Clause 205 (1) (

c) of the Act is amended by adding the following

subclause:

(i.1) a

record of all possible contraventions of clause 165 (1) (

a) in Ontario,

reported to him or her or concerning which he or she procures information,

(2) Clause

205 (1) (

e) of the Act is amended by adding “including accidents caused by

opening a door of a motor vehicle on a highway without taking due precautions”

after “motor vehicle accidents”.

Commencement

This Act comes into force on the day this Act receives Royal Assent.

The

short title of this Act is the Doored

But Not Ignored Act, 2019 .
